Opportunity description

1. The subject matter of the Contract is environmental radiation monitoring for the NPP construction stage. The subject matter of the Contract comprises: 1.1. Basic Scope: – Part 1 – Basic Radiation Monitoring, – Part 2 – Extended Radiation Monitoring. 1.2. Optional Scope: – Expansion of the scope of Extended Radiation Monitoring. 2. A detailed description of the subject matter of the Contract is contained in Appendix A to the Draft Contractual Provisions, constituting Appendix No. 1 to the SWZ. 3. This Procedure is conducted as an open tender pursuant to Article 132 in conjunction with Article 378 of the Act of 11 September 2019 – Public Procurement Law (consolidated text: Journal of Laws of 2026, item 793, as amended), (hereinafter: the Pzp Act). 4. The provisions of the Act of 29 June 2011 on the preparation and implementation of investments concerning nuclear power facilities and associated investments (Chapter 6) (consolidated text: Journal of Laws of 2025, item 1156, as amended), hereinafter referred to as the Investment Act, also apply to this Procedure. 5. Whenever this Notice refers to the Specification or SWZ, this means the Terms of Reference together with the appendices constituting an integral part thereof. 6. The Contracting Authority informs that the public procurement procedure will be conducted using the Contracting Authority’s Procurement Platform. 7. Website address of the conducted Procedure: https://pz.pej.pl (amendments and clarifications to the contents of the SWZ and other Contract documents directly related to the Contract award Procedure will be made available at this address). 8. In this procedure, communication between the Contracting Authority and Contractors, including the submission of Tenders, exchange of information, and transmission of documents or declarations, subject to the exceptions specified in the PZP Act, takes place using electronic means of communication via the Platform available at: https://pz.pej.pl. 9. A Contractor intending to participate in the contract award procedure must have an account on the Procurement Platform. Registration and maintenance of an account on the Procurement Platform and use of the Platform are free of charge. 10. The technical and organizational requirements for using the Platform are set out in the Platform Regulations (available at https://pz.pej.pl/user/terms). By joining the contract award procedure, i.e. by registering free of charge or logging in (if it has an account on the Platform), the Contractor accepts the terms of use of the Platform specified in the Regulations and acknowledges them as binding. 11. Detailed information concerning electronic means of communication is provided in point 17 of the SWZ. 12. Pursuant to Article 139(1) of the PZP Act, the Contracting Authority provides for the so-called reverse procedure, i.e. it will first examine and evaluate the Tenders to determine the highest-rated Tenders, and will then perform the qualitative selection of the Contractors whose Tenders were rated highest with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the Procedure. Information in this regard is provided in point 15 of the SWZ. 13. To confirm the absence of grounds for exclusion, the Contractor is required to submit with the Tender: 13.1) Pursuant to Article 393(1)(3) of the PZP Act, in order to demonstrate the absence of the grounds for exclusion referred to in point 13.3 of the SWZ, the Contractor shall submit a declaration, the template of which constitutes Appendix No. 10 to the SWZ. 13.2) Where relying on the capacities or situation of other entities providing resources, the Contractor shall submit, together with its declaration referred to in point 13.1) above, a declaration from the entity providing resources confirming the absence of grounds for exclusion. 13.3) Where Contractors jointly apply for the Contract, the declaration referred to in point 13.1) above shall be submitted by each of the Contractors jointly applying for the Contract. 13.4) Where the Contractor plans to entrust a part of the Contract constituting more than 10% of the Contract value to subcontractors and suppliers, and they are known, the Contracting Authority requires the Contractor to provide the declaration referred to in point 13.1) above with respect to those subcontractors and suppliers. 14. Pursuant to Article 139(2) of the PZP Act, in connection with point 2.3 of the SWZ, the Contracting Authority will require submission of the ESPD declaration exclusively from the Contractor whose Tender is rated highest. Information in this regard is provided in point 15 of the SWZ. 15. Before selecting the most advantageous tenders, the Contracting Authority will call upon the Contractors whose tenders were rated highest to submit, within a specified time limit of no less than 10 days, declarations and entity-specific evidence current as of the date of submission, as referred to in point 15 of the SWZ. 16. Pursuant to Article 42(2) of the Investment Act, the Contracting Authority informs that where, within a specified time limit, the Contractor has not submitted the entity-specific evidence required by the Contracting Authority referred to in point 15.4 of the SWZ, or has not submitted powers of attorney, or has submitted the evidence required by the Contracting Authority referred to in point 15.4 of the SWZ containing errors, or has submitted defective powers of attorney, the Contracting Authority shall call upon it to submit, as applicable, the entity-specific evidence or powers of attorney within a specified time limit, no more than three times, unless, despite their submission, the Contractor’s Tender is subject to rejection or it would be necessary to cancel the Procedure. The evidence submitted at the request of the Contracting Authority should confirm the Contractor’s fulfillment of the conditions for participation in the Procedure and the offered services’ fulfillment of the requirements specified by the Contracting Authority no later than the date on which the deadline for submission of Tenders expired. 17. Information on entity-specific evidence concerning Contractors having their registered office or place of residence outside the territory of the Republic of Poland is provided in points 15.6–15.8 of the SWZ. 1. The subject matter of the Contract is environmental radiation monitoring for the NPP construction stage, i.e. periodic measurements of the ionizing radiation background, including concentrations of radioactive isotopes of natural and artificial origin in environmental components. 2. Provision of the services referred to in point 1 above comprises: 2.1. Basic Scope: – Part 1 – Basic Radiation Monitoring, – Part 2 – Extended Radiation Monitoring. 2.2.
