1. The subject matter of the contract is the supply of servers with licences. The subject matter of the contract has been divided into two parts: Part I – supply of servers with software Part II – supply of server and database software. 2. Detailed information concerning the description, scope and conditions for the performance of the subject matter of the contract is set out in: 1) With regard to Part I of the contract – the “Description of the Subject Matter of the Contract (OPZ)”, constituting Annex No. 2A to the SWZ, and the “Draft contractual provisions that will be incorporated into the contract to be concluded”, constituting Annex No. 3A to the SWZ; 2) With regard to Part II of the contract – the “Description of the Subject Matter of the Contract (OPZ)”, constituting Annex No. 2B to the SWZ, and the “Draft contractual provisions that will be incorporated into the contract to be concluded”, constituting Annex No. 3B to the SWZ. 3. The Contracting Authority informs that a tender submitted as part of the procedure may not include ICT products and ICT services indicated in the recommendations referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT products or ICT services specified in decisions concerning the recognition of a supplier as a high-risk supplier, as referred to in Article 67b(15) of the aforementioned Act. Detailed requirements in this regard are set out in the OPZ constituting, respectively: Annex No. 2A to the SWZ (for Part I of the contract) and Annex No. 2B to the SWZ (for Part II of the contract). A tender that does not meet these requirements will be subject to rejection pursuant to Article 226(1)(17) or (19) of the Act. 4. The Contracting Authority does not permit the submission of a variant tender, as referred to in Article 92 of the Act, i.e. a tender providing for a method of performing the contract different from that specified in this SWZ. 5. The Contracting Authority divides the contract into parts. Accordingly, the Contracting Authority permits the submission of tenders for parts, as referred to in Article 7(15) of the Act. 6. The Contracting Authority permits the submission of tenders for parts (Parts I and II of the subject matter of the contract) for any selected part of the subject matter of the contract (the contractor may submit a tender for both parts of the contract). 7. The Contracting Authority will evaluate tenders separately for each part of the subject matter of the contract. 8. The Contracting Authority reserves the right to select a tender separately for each part of the subject matter of the contract – the most advantageous tender among the tenders submitted for a given part of the contract will be selected on the basis of the tender evaluation criteria specified in point 14 of the SWZ. 9. In the event of circumstances requiring the cancellation of the procedure, the Contracting Authority will cancel the procedure only for the relevant part. 10. The Contracting Authority does not envisage awarding contracts pursuant to Article 214(1)(7) and (8) of the Act. 11. It is not permissible for one Contractor to submit more than one tender for one part of the contract. 1. The subject matter of the contract in Part I is the supply of servers with software. 2.
