Opportunity description

1. Pursuant to Art. 38(1) of the Act of 11 September 2019 – Public Procurement Law (consolidated text: Journal of Laws of 2026, item 793, as amended), the Contracting Authority acts as the Authorised Representative under the Agreement concluded on 25.11.2024 concerning the implementation of the Project entitled: “Increasing the effectiveness of conducting long-term rescue operations – stage II” and under the authorisation to conduct and award a joint contract on its own behalf and on behalf and for the benefit of: - the Lublin Voivodeship Commander of the PSP, - the Opole Voivodeship Commander of the PSP, hereinafter referred to as the Recipients. 2. The subject matter of the procedure is the award of a public contract for the supply of 4 light water rescue vehicles for a specialist water and diving rescue group, with 4x4 drive, intended for PSP organisational units from three voivodeships: Warmian-Masurian (2 units), Lublin (1 unit), Opole (1 unit). The subject matter of the contract has been divided into 2 parts. Part No 1 - Light water rescue vehicle for a specialist water and diving rescue group, with 4x4 drive - 2 units. Part No 2 - Light water rescue vehicle for a specialist water and diving rescue group, with 4x4 drive - 2 units. 3. A detailed description of the subject matter of the contract is contained in the annexes to the SWZ, i.e. Annex No 1 entitled “Description of the subject matter of the contract”, containing the minimum technical and operational requirements for the subject matter of the contract (the same for each vehicle), and Annex No 2 entitled “Draft contract”, specifying the detailed conditions for performance of the subject matter of the contract. 4. The subject matter of the contract must be brand-new, unused, technically sound, safe, compliant with the applicable norms and quality standards, complete and ready for use, and must also meet the minimum technical, functional and quality requirements specified in Annex No 1 to the SWZ. 5. When calculating the price for the subject matter of the contract, the Contractor is obliged to take into account all costs associated with performing the contract in accordance with the SWZ, including its annexes containing the description of the subject matter of the contract, until the subject matter of the contract has been accepted by the Contracting Authority without any reservations. 6. Any names (trademarks), standards, assessments and technical specifications provided by the Contracting Authority in the Description of the subject matter of the contract are examples, and their indication is intended to define the expected standard, while the Contracting Authority permits the submission of equivalent tenders pursuant to Art. 101(4), (5), (6) of the Pzp Act in conjunction with Art. 99 of the Pzp Act. If specific standards, assessments and technical specifications have been indicated in the procurement documentation, the Contracting Authority states that it permits the use of solutions equivalent to those described by these standards. A Contractor relying on equivalent solutions described by the Contracting Authority is obliged to demonstrate in its tender - in particular by means of subject-matter evidence - that the supplies it offers meet the requirements specified by the Contracting Authority. The trademarks, patents or origin, sources or specific processes indicated in the documentation that characterise the origin of materials, equipment and services are provided for guidance; the use of “equivalent” materials, equipment and other products is permitted, provided that technical parameters equal to or better than those obtained through implementation in accordance with the technical documentation are achieved and provided that their use does not necessitate redesigning the solutions contained in the technical documentation. A Contractor relying on solutions “equivalent” to those described by the Contracting Authority is obliged to demonstrate that the products and equipment it offers meet the requirements specified by the Contracting Authority. In such a case, a description of the proposed product or equipment, additionally containing its technical parameters and the manufacturer's name, must be attached to the tender. If the Contractor proposes an equivalent product, this information must be included in the tender (the technical specification supplemented by the Contractor with an additional column must then be attached - Annex No 1 to the SWZ). 1. A detailed description of the subject matter of the contract is contained in the annexes to the SWZ, i.e. Annex No 1 entitled “Description of the subject matter of the contract”, containing the minimum technical and operational requirements for the subject matter of the contract (the same for both vehicles), and Annex No 2 entitled “Draft contract”, specifying the detailed conditions for performance of the subject matter of the contract. 3.
