Poland – Fleet management, repair and maintenance services – Launch and operation of the Opole Municipal Bicycle System within the City of Opole

Opportunity description

The subject matter of the contract is the launch and operation of the Opole Municipal Bicycle System, hereinafter referred to as ORM, within the City of Opole. In performing the subject matter of the contract, the Contractor shall in particular: 1) prepare and agree with the Contracting Authority the designs of: a) bicycles that will be made available to ORM customers, b) visualisations of bicycle station totems and ORM parking place signs enabling a bicycle to be rented or returned, c) documents defining the rights and obligations of customers and the Contractor, in particular the regulations for using ORM and the necessary documents concerning the personal data protection policy, d) the ORM website, e) bicycle station locations and traffic organisation change plans (if necessary); 2) prepare and equip ORM with the infrastructure necessary for its proper functioning, including, inter alia: bicycle stations (totems, bicycle racks, concrete block paving, bicycles, software); 3) launch and operate the Customer Service Office (BOK); 4) train designated employees of the Contracting Authority in the use of ORM and in monitoring and obtaining data from the ORM IT system; 5) conduct a trial run, launch and operate ORM during the term of the Contract, taking into account the time requirements described in § 2 of the Contract; 6) dismantle the infrastructure installed in Opole’s public space, taking into account the requirements described in § 2(4) of the Contract; 7) immediately after ORM ceases operating, inform all ORM customers electronically that ORM has ceased operating and settle financial accounts with ORM Customers and issue refunds. The detailed scope of the contract is set out in the Description of the Subject Matter of the Contract (OPZ), which constitutes an annex to these procurement specifications. Contract performance period: From the date of signing the contract until 22 December 2028 (planned contract signing date – 1 August 2026), whereby: 1. The Contractor is required to launch ORM within …… days from the date of signing the Contract (depending on the “ORM launch deadline” criterion offered in the tender). 2. The Contractor is to operate ORM for three seasons, i.e. from the date specified in the contract until 30 November 2026, from 1 March 2027 to 30 November 2027, and from 1 March 2028 to 30 November 2028. 3. After the end of the third season of Contract performance, i.e. after 30 November 2028, the Contractor shall be obliged, within 14 days from the end of the provision of the rental service, to dismantle all infrastructure associated with ORM, except for the installed paved surfaces and the installed “inverted U-shaped” racks. 4. The Contracting Authority does not envisage a contract as referred to in Article 214(1)(7) of the Law. List of declarations or documents submitted by the Contractor together with the tender: 1) The “Tender Offer” form, prepared using the template constituting an annex to the SWZ. 2) Declaration by contractors jointly applying for the award of the contract. Contractors jointly applying for the contract shall submit, together with the tender, a declaration indicating which construction works, supplies or services will be performed by each contractor (Article 117(4) of the Law). A declaration template is attached to the SWZ. 3) Commitment of an entity, if the Contractor relies on its resources. Where technical or professional capacity is demonstrated that will be made available by another entity, the Contractor shall attach to the tender a commitment signed in accordance with the provisions of the SWZ – Chapter 10 – Other recommendations and reservations. A commitment template is attached to the SWZ. 4) Declaration by the contractor/contractor jointly applying for the award of the contract concerning the grounds for exclusion under Article 5k of Council Regulation (EU) No 833/2014 and Article 7(1) of the Act on Special Solutions for Counteracting Support for Aggression against Ukraine and Protecting National Security, submitted pursuant to Article 125(1) of the Law. A declaration template is attached to the SWZ. 5) Declaration by the entity making resources available concerning the grounds for exclusion under Article 5k of Council Regulation (EU) No 833/2014 and Article 7(1) of the Act on Special Solutions for Counteracting Support for Aggression against Ukraine and Protecting National Security, submitted pursuant to Article 125(1) of the Law. A declaration template is attached to the SWZ. 6) Power of attorney, if the Contractor has appointed an attorney-in-fact; a power of attorney is mandatory in the case of a consortium. 7) An extract or information from the National Court Register, Central Register and Information on Economic Activity, or another appropriate register, in order to confirm that the person acting on behalf of the Contractor is authorised to represent it—in the event that the Contractor has not indicated in the “Tender Offer” form the address of a website or another publicly accessible, free database containing the Contractor’s registration data. 8) A document confirming payment of the tender security.
