Poland – Forestry services – DYNAMIC PURCHASING SYSTEM - Performance of forestry services and the felling of trees and shrubs on land covered by ZRID decisions within the forest districts of the Regional Directorate of State Forests in Zielona Góra in the years 2027-2030

Opportunity description

The subject matter of the Dynamic Purchasing System ("DPS") comprises forestry services, as defined in Article 6(1)(1) of the Act of 28 September 1991 on Forests (consolidated text: Journal of Laws of 2026, item 663 – hereinafter the “Forests Act”), including work relating to forest cultivation and protection, fire protection, timber harvesting and skidding, and other forestry services, including game management and meadow and agricultural management, scheduled to be performed within the forest districts of the respective Contracting Authority, as well as work involving the felling of trees and shrubs on land covered by decisions authorising the implementation of road investments (hereinafter ZRID), carried out pursuant to agreements concluded between forest districts (the Contracting Authority) and road authorities during the period for which the DPS is established. The Specification of Contract Terms ("SWZ") constitutes the Procurement Documents and simultaneously serves as information on the application of the dynamic purchasing system and as the specification of contract terms for contract award procedures covered by the dynamic purchasing system, with the proviso that detailed information concerning the subject matter of a given contract covered by the dynamic purchasing system and other information concerning such procedures specified in Article 323(3) of the PZP will be set out in the invitations to submit tenders for the individual procedures covered by the DPS. The subject matter of the Dynamic Purchasing System ("DPS") comprises forestry services, as defined in Article 6(1)(1) of the Act of 28 September 1991 on Forests (consolidated text: Journal of Laws of 2026, item 663 – hereinafter the “Forests Act”), including work relating to forest cultivation and protection, fire protection, timber harvesting and skidding, and other forestry services, including game management and meadow and agricultural management, scheduled to be performed within the forest districts of the respective Contracting Authority, as well as work involving the felling of trees and shrubs on land covered by decisions authorising the implementation of road investments (hereinafter ZRID), carried out pursuant to agreements concluded between forest districts (the Contracting Authority) and road authorities during the period for which the DPS is established. The material scope of the DPS contracts comprises the aggregate quantities of work relating to forest cultivation and protection, fire protection, timber harvesting and skidding, game management and meadow and agricultural management, and other forestry services resulting from Annex No. 2 to the SWZ for the DPS – the planned volume of work during the period for which the DPS is established. The material scopes listed in Annex No. 2 for the DPS are estimates. The detailed description of the subject matter of the contract and the quality standards relating to all essential characteristics of the subject matter of the contract for a given contract awarded under the DPS will be specified in the invitation to submit tenders in the contract award procedure covered by the DPS. During the performance of the subject matter of a contract awarded under the DPS, in addition to the laws in force within the territory of the Republic of Poland, the Contractor will be required to apply and comply with the obligations and rules arising from the regulations available on the website at https://www.zielonagora.lasy.gov.pl/przetargi-zamowienia-zarzadzenia. Pursuant to Article 95 of the PZP, when performing a contract awarded under the DPS, the Contracting Authority requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons performing contract-related activities involving the harvesting and skidding of timber, where the performance of those activities constitutes work performed in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – the Labour Code (consolidated text: Journal of Laws of 2025, item 277, as amended).
