1. The subject matter of the contract is services involving the felling of trees and shrubs and their removal from properties located within the boundaries of the Strzebielino Forest District, designated for infrastructure investments carried out pursuant to the so-called special acts, i.e.: a) the Act of 10 April 2003 on special rules for the preparation and implementation of investments in public roads (consolidated text: Journal of Laws of 2024, item 311) – in the case of the task for which the investor is the General Directorate for National Roads and Motorways, entitled “Construction of a national road on the Lubiatowo – S6 expressway section. Task 2: provincial road No. 213 – district road DP1455G”; b) the Act of 24 July 2015 on the preparation and implementation of strategic investments in transmission networks (consolidated text: Journal of Laws of 2024, item 1199) – in the case of tasks for which the investor is Polskie Sieci Elektroenergetyczne S.A., entitled: “Construction of the 400 kV Choczewo line - to the cut-in of the Gdańsk Błonia-Grudziądz Węgrowo line”. 2. The subject matter of the contract has been divided into lots: a) lot 1 – felling of trees and shrubs and their removal from properties designated for the “Construction of a national road on the Lubiatowo – S6 expressway section. Task 2: provincial road No. 213 – district road DP1455G”, located within the boundaries of the Strzebielino Forest District; b) lot 2 – felling of trees and shrubs and their removal from properties designated for the “Construction of the 400 kV Choczewo line - to the cut-in of the Gdańsk Błonia-Grudziądz Węgrowo line”, located within the boundaries of the Strzebielino Forest District. 3. The material scope of the subject matter of the contract covers the aggregate quantities of work involving: a) timber harvesting and skidding, b) shredding trees in plantations and young stands, c) cutting undergrowth and advance growth, d) site clearance (only in lot 2 of the contract), e) dismantling and installation of fencing (only in lot 2 of the contract). 4. The subject matter of the contract is services involving the felling of trees and shrubs and their removal from properties located within the boundaries of the Strzebielino Forest District, designated for an infrastructure investment carried out pursuant to the so-called special act, i.e.: the Act of 10 April 2003 on special rules for the preparation and implementation of investments in public roads (consolidated text: Journal of Laws of 2024, item 311) – for which the investor is the General Directorate for National Roads and Motorways, entitled “Construction of a national road on the Lubiatowo – S6 expressway section. The material scope of the subject matter of the contract covers the aggregate quantities of work involving: a) timber harvesting and skidding, b) shredding trees in plantations and young stands, c) cutting undergrowth and advance growth, resulting from Annexes No. 2.A for lot 1 to the SWZ. 3. The quantities of work specified in Annex No. 2.A that fall within the scope of the Subject Matter of the Contract (and priced by the Contractor in the tender cost estimate forming part of the Tender), regardless of the unit of measurement in which they are expressed, are estimates. During the performance of the Contract, the Contracting Authority may commission a smaller or larger scope of individual works than specified in the SWZ, including complete withdrawal from individual items, provided, however, that the value of the commissioned works will be no less than the equivalent of 50% and no more than the equivalent of 120% of the Remuneration referred to in § 10(1) of the Model Contract (Annex No. 12.A). The above modifications may not constitute grounds for any claims by the Contractor against the Contracting Authority, regardless of their legal basis. 4. The quality standards relating to all essential characteristics of the subject matter of the contract are specified in Annex No. 3.A to the SWZ, “Description of the technology for performing the works together with the works acceptance procedure” – hereinafter “OTWP”. The detailed description of the technology for performing individual works (activities), set out in Annex No. 3.A to the SWZ, constitutes the basis for defining the quality requirements relating to the elements comprising the subject matter of the contract (Annexes No. 2.A to the SWZ). 1.
