1. The subject matter of the contract is the successive supply of Ekodiesel diesel fuel to the Contracting Authority’s premises in Zakopane at ul. Szymony 17a, in accordance with the Contracting Authority’s current demand. The fuel (diesel fuel) that is the subject matter of this tender will be used by the Contracting Authority exclusively for its own purposes to refuel company vehicles. The Contracting Authority informs that the fuel (diesel fuel) that is the subject matter of this procedure will not be resold. 2. The estimated anticipated quantity of Ekodiesel diesel fuel to be supplied during the period of 18 months from the date of signing the contract is: 2.1. Basic contract 450,000 litres. 2.2. Option right 150,000 litres. 3. In accordance with the reservation under the option right, the Contracting Authority will definitively purchase diesel fuel in the “guaranteed” quantity. 4. The remaining quantities described as the “option” will be purchased depending on the Contracting Authority’s actual needs, in accordance with the provision concerning the exercise of the option right set out below. 5. OPTION RIGHT (Article 441 of the PZP Act): a) The Contracting Authority, in accordance with the content of point 4.5. above, reserves the right to exercise the option right depending on actual needs. b) If the Contracting Authority exercises the option right: - The Contractor will be required to apply the terms and prices consistent with the submitted tender, - The Contractor will be entitled to additional remuneration calculated in accordance with the rules described in the procedure. c) The option right will be activated after the guaranteed quantity under the basic contract has been exhausted, without the need to notify the Contractor. d) The option right is an entitlement of the Contracting Authority which it may, but is not required to, exercise in the performance of this contract. If the Contracting Authority does not exercise the option right or exercises it only partially, the Contractor will not be entitled to any claims on this account. 6.
