Opportunity description
1. The subject matter of the contract is the supply of furniture, including carrying in and assembly, hereinafter referred to in the SWZ as the “assortment”. 2. A detailed description of the subject matter of the contract is provided in Annex No. 5 to the SWZ and Chapter XIX of the SWZ. 3. The Contractor will be required to provide a 24-month guarantee and statutory warranty for the supplied assortment. 4. The Contracting Authority requires the Contractor to indicate in the tender the manufacturer/model or other data unambiguously identifying the offered assortment. The term “Manufacturer” shall mean the name of the company under which the offered assortment is sold or the entrepreneur placing the assortment on the market in the territory of the Republic of Poland. If the Contractor does not indicate the Manufacturer/other data unambiguously identifying the assortment, the Contracting Authority will reject the tender pursuant to Article 226(1)(5) of the Act as non-compliant with the contract conditions. 5. The Contracting Authority requires the submission, together with the tender, of product-related evidence confirming that the offered assortment complies with the requirements specified in the description of the subject matter of the contract relating to contract performance, in the form of: a catalogue sheet separately for each assortment item, confirming: model, dimensions, type of material. 6. The Contracting Authority accepts equivalent product-related evidence if it confirms that the offered assortment meets the requirements specified by the Contracting Authority. Product-related evidence produced by a Contractor that is not the Manufacturer will not be considered equivalent. 7. If the Contractor does not submit product-related evidence together with the tender or the product-related evidence is incomplete, the Contracting Authority will not request its submission or supplementation and will reject the tender pursuant to Article 226(1)(2)(c). 8. The Contracting Authority may request that Contractors provide explanations concerning the content of the submitted product-related evidence. 9. Product-related evidence prepared in a foreign language must be submitted together with a translation into Polish. 10. The Contracting Authority permits the performance of part of the contract to be entrusted to a Subcontractor. 11. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract whose performance it will entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 12. Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the “GDPR”, the Contracting Authority informs that: 1) the controller of your personal data is the Warsaw Metropolitan Police Commander; 2) supervision over the proper processing of personal data is exercised by the data protection officer: address: ul. Contractors that are not subject to exclusion pursuant to Article 108(1) of the Act and Article 109(1)(1), (4), (7), (8) and (10) of the Act, as well as Article 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security (i.e. Journal of Laws of 2025, item 514), and Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 229 of 31.7.2014, p. 1), as amended, hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L111 of 8.4.2022, p. 1) and as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, may apply for the award of this contract. 16. The Contracting Authority does not require the Contractor to demonstrate fulfilment of the conditions specified in Article 112(2) of the Act. 1.
