1. The subject matter of the contract is the conclusion of framework agreements for the supply of mobile phones, hereinafter referred to in the SWZ as the “assortment”. 2. The Contracting Authority permits the submission of tenders for parts of the contract, divided into the following 4 tasks: 1) Task No. 1 – Mobile phone – type 1; 2) Task No. 2 – Mobile phone – type 2; 3) Task No. 3 – Mobile phone – type 3; 4) Task No. 4 – Mobile phone – type 4. 3. A detailed description of the subject matter of the contract is provided in Chapter XIX of the SWZ and Annex No. 5A-5D (as applicable to the task) to the SWZ and Chapter XIX/XIXa of the SWZ. 4. The Contractor will be required to provide a 24-month statutory warranty and guarantee for the supplied assortment, calculated from the date on which the Parties sign the final delivery acceptance protocol without reservations. The statutory warranty period may not be shorter than the guarantee period. 5. The Contracting Authority will not require the submission of subject-matter evidence together with the tender. 6. The Contracting Authority requires that the offered ICT products do not include: 1) ICT products indicated in the recommendation referred to in Article 34(4) of the Act of 5 July 2018 on the National Cybersecurity System, stating their negative impact on the fundamental national security interest; 2) an ICT product whose type has been specified in the decision on recognizing the supply as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System; Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Article 226(1)(17) or (19) of the Act. 7. The Contracting Authority permits the performance of part of the contract to be entrusted to a Subcontractor. 8. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract whose performance it will entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 9. Assortment delivery deadline: up to 30 working days, calculated from the date of conclusion of the specific contract or acceptance of the requisition. 10. If, as a result of this procedure, a contract is concluded with one Contractor, the Contracting Authority will award the public contract pursuant to Article 313 of the Act, i.e. on the basis of the framework agreement, the template for which constitutes Annex XIXa to the SWZ. 11. The type and scope of amendments to the contract are specified in Chapter XIX/XIXa of the SWZ. 12. Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as “RODO”, the Contracting Authority informs that: 1) the controller of your personal data is the Commander of the Warsaw Metropolitan Police; 2) supervision over the proper processing of personal data is exercised by the data protection officer: address: ul. Nowolipie 2, 00-150 Warszawa; 13. Tender validity period until 23.12.2026. 14. The Contracting Authority does not require the Contractor to demonstrate compliance with the conditions specified in Article 112(2) of the Act.
