The subject matter of the contract is the preparation of design documentation and the execution of construction works, including site development, for the investment entitled: “Establishment of the Małopolska Centre for Psychiatry and Treatment of Addiction to New Digital Technologies”. The subject matter of the contract is to be delivered under the “design and build” formula. 1. The subject matter of the contract is the preparation of design documentation and the execution of construction works, including site development, for the investment entitled: “Establishment of the Małopolska Centre for Psychiatry and Treatment of Addiction to New Digital Technologies”. The subject matter of the contract is to be delivered under the “design and build” formula. 2. The subject matter of the contract has been described in detail in the Functional and Utility Programme constituting Annex No. 2 to the SWZ and in the Draft Agreement constituting Annex No. 6 to the SWZ. 3. The investment will be implemented on the property located at Strzelecka Street in Kraków, on plots No. 28/4 and 28/3, cadastral district 0051, cadastral unit 126105_9, Kraków-Śródmieście district office. 4. The investment is located within the boundaries of the historic urban layout of the Wesoła Area, entered in the register of monuments by the decision of 16 February 1984 under number A-650, and in the strict centre of the City of Kraków. When calculating the tender price and the deadlines for performance of the contract, the Contractor is obliged to take into account the resulting formal and legal, conservation, organisational, logistical and traffic-related conditions, as well as those associated with carrying out construction works in dense urban development. 5. The scope of the works planned for implementation comprises the following stages: 5.1. Phase I – Design, comprising the preparation of complete design documentation enabling the obtaining of a final building permit decision, the execution of construction works and the commissioning of the Facility, including in particular: a) preparation of a building design comprising a site development plan (PZT), an architectural and construction design (PAB), and all studies, analyses, expert opinions, opinions, arrangements, technical conditions, permits, consents and administrative decisions required by law or by the competent public administration authorities, b) preparation of the technical design together with all required discipline-specific studies, c) obtaining, on the basis of a power of attorney granted by the Contracting Authority, a final building permit decision, d) preparation of a medical technology design together with the layout, parameterisation and installation requirements for medical devices and equipment, e) preparation of a detailed specification of non-medical equipment, including furniture, staff facilities, administrative, technical and IT equipment, as well as other equipment necessary for the operation of the Facility, together with the specification of technical parameters, quantities, installation requirements and locations, f) preparation of detailed designs, g) preparation of bills of quantities, cost estimates, a material and financial schedule, and Technical Specifications for the Execution and Acceptance of Construction Works (STWiORB), with the cost estimates and material and financial schedule required to distinguish the material and financial scopes corresponding to the funding sources indicated by the Contracting Authority, h) preparation of visualisations in accordance with the requirements set out in the PFU and the Agreement, i) preparation of all changes, updates and replacement documentation necessary for the implementation of the Investment, including documentation required to obtain a decision amending the building permit, if obtaining such a decision proves necessary, j) provision of author’s supervision throughout the entire period of execution of the construction works until the occupancy permit is obtained. 5.2. Phase II – Construction works, comprising: a) effectively notifying the competent architectural and construction administration authority of the commencement of construction works, on the basis of a power of attorney granted by the Contracting Authority, b) execution of construction works, including site development, construction of utility connections, delivery and installation of equipment, and execution of all preparatory, temporary, protective, demolition, reinstatement, connection, cleaning and other works necessary to achieve the purpose of the Agreement, c) preparation of complete as-built documentation, including in particular surveying documentation, acceptance documentation, operating and maintenance instructions, photographic documentation and documentation required to obtain an occupancy permit, d) obtaining, on the basis of a power of attorney granted by the Contracting Authority, a final decision granting an occupancy permit for the Investment.
