1. The subject of the contract covers the performance of the task entitled: “Collection and transport of municipal waste from residential properties located within the Łysomice municipality” and the provision of containers and bags for the selective collection of municipal waste to these properties. 2. Detailed information concerning the subject of the contract is contained in Annex No. 3 to the SWZ entitled DETAILED DESCRIPTION OF THE SUBJECT OF THE CONTRACT and Annex No. 9 to the SWZ entitled CHARACTERISTICS OF THE ŁYSOMICE MUNICIPALITY. 3. The tender price must be complete, unambiguous and final. The Contractor shall calculate the price on the basis of the Procurement Specifications together with the annexes. The tender valuation must take into account all necessary elements and anticipated costs associated with performance of the task. The Contractor bears sole responsibility for examining the subject of the contract with due diligence and for obtaining information regarding each and every condition and obligation that may in any way affect the value or nature of the tender or the performance of the subject of the contract. 4. Submission of a tender shall be deemed to mean that the Contractors have familiarised themselves with all relevant acts and other provisions of law applicable within the territory of the Republic of Poland that may in any way affect or concern the activities and actions covered by the tender and the resulting public procurement contract. 5. Due to the value of the contract exceeding the EU threshold for services, the procedure is being conducted as an open procedure pursuant to Article 132 of the Pzp Act. In accordance with Article 139 point 1 of the Pzp Act, the Contracting Authority shall first examine and evaluate the tenders and then assess the eligibility of the contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. In accordance with Article 126 point 1 of the Pzp Act, before selecting the most advantageous tender, the Contracting Authority shall request the contractor whose tender received the highest evaluation to submit, within a specified period of no less than 10 days, means of evidence concerning the entity that are current as of the date of submission.
