Opportunity description

The public procurement procedure is conducted under the open tender procedure pursuant to Article 132 et seq. of the Act of 11 September 2019 – Public Procurement Law (Journal of Laws of 2024, item 1320, as amended), hereinafter also referred to as the “Pzp”. The procedure concerns a contract with a value above the EU thresholds specified in the announcement of the President of the Public Procurement Office issued pursuant to Article 3 of the Pzp Act. The Contracting Authority envisages applying the so-called reverse procedure referred to in Article 139(1) of the Pzp Act, i.e. the Contracting Authority will first examine and evaluate the tenders and then perform the entity-related qualification of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. The subject matter of the contract is the delivery of an update to the intraoperative X-ray imaging device as part of the expansion of the equipment base of the Neurosurgery Department, as implementation of the Lower Silesian Voivodeship grant for the task “Improvement of the treatment facilities” pursuant to Agreement No. DZ-N/13/2025 dated 12 February 2025. The contract is financed from the budget of the Lower Silesian Voivodeship under the designated grant awarded for the implementation of the task “Improvement of the treatment facilities” pursuant to Agreement No. DZ-N/13/2025 dated 12 February 2025, concluded between the Contracting Authority and the Lower Silesian Voivodeship, on the basis of Resolution No. 1458/VII/25 of the Executive Board of the Lower Silesian Voivodeship dated 17 January 2025 concerning the award, in 2025, of a grant to the T. Marciniak Lower Silesian Specialist Hospital – Emergency Medicine Centre in Wrocław for the implementation of the task entitled:; “Improvement of the treatment facilities”. A detailed description of the subject matter of the contract for the above-mentioned part has been set out and described in the: “Price Form” (Appendix No. 2), “Parameters Sheet” (Appendix No. 3), and “Draft Contractual Provisions” (Appendix No. 4), which constitute an integral part of the Specification of Contract Terms. The contractual conditions for the performance of the public contract in question are contained in the “Draft Contractual Provisions”, which constitute an integral part of the SWZ. The Contractor undertakes to sign a personal data processing entrustment agreement upon conclusion of the contract (in accordance with Appendix No. 12 to the SWZ). A detailed description of the subject matter of the contract for the above-mentioned part has been set out and described in the: “Price Form” (Appendix No. 2), “Parameters Sheet” (Appendix No. 3), and “Draft Contractual Provisions” (Appendix No. 4), which constitute an integral part of the Specification of Contract Terms.
