Opportunity description

1. The subject of the contract is the supply of a laboratory incubator, hereinafter referred to as the “equipment”, for the Faculty of Biology of the University of Gdańsk. 2. The contract includes the delivery and installation of the equipment at the location indicated by the Contracting Authority. 3. Common Procurement Vocabulary (CPV) classification code: 33152000-0 (incubators). 4. A detailed description of the subject of the contract is set out in the description of the subject of the contract – Appendix No. 5 to the SWZ. 5. Place of delivery of the equipment: University of Gdańsk, Faculty of Biology, Department of Evolutionary Genetics and Biosystematics, ul. Wita Stwosza 59, 80-308 Gdańsk, room B108. 6. The Contracting Authority requires a 24-month warranty for the equipment. Details concerning the warranty are contained in § 7 of the draft contract – Appendix No. 4 to the SWZ. 7. If anywhere in the SWZ, including in the description of the subject of the contract – Appendix No. 5 to the SWZ, the standards referred to in Article 101(1)(2) and (3) of the Pzp have been indicated, it shall be understood that such indication is accompanied by the words “or equivalent”, and the Contracting Authority permits the offering of solutions equivalent to those described. Equivalence shall be understood to mean that equivalent solutions will guarantee performance of the contract in accordance with the description of the subject of the contract and will ensure that the requirements specified in the description of the subject of the contract – Appendix No. 5 to the SWZ – are met to an equivalent degree. The application must correspond, in its type and scope, to the objectives assumed in the standards referred to in the description of the subject of the contract, as mentioned in Article 101(1)(2) and (3) of the Pzp. 8. Due to the fact that various equivalent proposals are permitted, the Contractor is required to verify and treat all solutions as interconnected. Demonstrating equivalence, i.e. meeting to an equivalent degree the requirements specified by the Contracting Authority in the description of the subject of the contract, is the responsibility of the Contractor. If equivalent solutions are used in the tender, the Contractor is obliged to select the appropriate option in point 5 of the tender form – Appendix No. 1 to the SWZ, and is also obliged to indicate in its tender which standards referred to in the description of the subject of the contract have been replaced and state which equivalent solutions it proposes in their place. The Contracting Authority will not reject the Contractor’s tender solely because the offered supply does not comply with the standards referred to in the description of the subject of the contract, provided that the Contractor proves in the tender, in particular by means of the subject-matter evidence referred to in Articles 104–107 of the Pzp, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree (Article 101(5) of the Pzp).
