Opportunity description

The subject matter of the contract is the supply of an educational workstation with a 6-axis robot (8 units) intended for learning programming and simulating industrial processes, together with a desktop computer and a set of accessories. Where the documentation made available contains names of manufacturers, products or solutions, references to trademarks, patents or origin, source of origin or a specific process that characterizes the products or services supplied by a particular contractor, the Contracting Authority permits the offering of materials, equipment and solutions equivalent in terms of technical, quality, functional and operational parameters, provided that they ensure parameters no worse than those specified in the annexes to the SWZ. The Contracting Authority informs that the description of the subject matter of the contract in the SWZ by indicating proprietary names, etc., is intended solely to clarify the subject matter of the contract. The Contracting Authority requires the Contractor to present evidence of equivalence in the tender. The Contracting Authority indicates that the obligation to declare in the tender solutions equivalent to those described in the SWZ and to demonstrate equivalence rests with the Contractor. General requirements 1. The Contracting Authority requires the subject matter of the contract to be brand-new, fully functional, free from all defects and damage, and not previously used. 2. The Contracting Authority requires the subject matter of the contract to comply with the recommendations, standards and applicable technical and operational requirements in force within the Republic of Poland and the European Union (CE declarations). The subject matter of the contract must meet technical and functional occupational health and safety requirements. 3. The Contracting Authority requires the Contractor, upon delivery of the subject matter of the contract, to include operating instructions for the educational workstations in Polish, in paper and electronic versions. 4. The Contractor undertakes to deliver, at its own expense, all components comprising the subject matter of the contract, together with the technical documentation provided by the manufacturer, warranty cards and documents specifying the rules for providing services during the warranty period, and to assemble them and verify that they can be started and operated at the places of use, on a date agreed in advance with the Director of the Complex of Technical Schools in Rybnik. 6. The workstations must be available in regular production and may not be prototypes. 7. The description of the requirements is contained in Annex No. 7 to the SWZ. 8. The minimum warranty period for the offered subject matter of the contract may not be shorter than 24 months (if a shorter period is offered, the tender will be rejected pursuant to Article 226(1)(5) of the Pzp Act because its content will not comply with the contract conditions). The deadline for remedying defects is up to 14 days. 9. Where the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and Article 101(3) of the Act, the Contracting Authority permits solutions equivalent to those described. 1. The subject matter of the contract is the supply of an educational workstation with a 6-axis robot intended for learning programming and simulating industrial processes, together with a desktop computer and a set of accessories. The description of the requirements is contained in Annex No. 7 to the SWZ. 2. Contractors that meet the condition for participation in the procedure concerning technical or professional capacity may apply for the award of the contract. The Contractor will meet the condition if it demonstrates that, during the last 3 years, or, if the period of conducting business is shorter, during that period, it has completed at least 2 supplies, each with a value of at least PLN 100,000.00 gross, and each involving the supply of equipment for educational workstations in the field of robotics. For supplies whose value was expressed in the contract in a currency other than PLN, that currency must be converted into PLN using the average NBP exchange rate on the date the supply was completed (in the case of services settled exclusively in currencies other than PLN). 3. The condition for participation in the procedure concerning technical or professional capacity relating to completed supplies must be met: 1) independently by the Contractor; or 2) independently by at least one entity making knowledge and experience available (subcontractor); 3) in the case of Contractors applying jointly, independently by at least one of the Contractors applying jointly. Combining (adding together) the experience required above as part of the experience of different entities involved in performing the contract is not permitted. 4. Where the Contractor relies on the experience of a group of Contractors of which it was a member (e.g. a Consortium), the experience will be assessed according to the specific scope of that Contractor’s participation, i.e. its actual contribution to carrying out the activities required of that group under the public contract cited to confirm compliance with the condition for participation in the procedure. 5. In the case of Contractors applying jointly for the award of the contract, none of them may be subject to exclusion pursuant to Article 108(1) of the Act. 6. To confirm compliance with the conditions for participation in the procedure, in appropriate situations and with regard to a specific contract or part thereof, the Contractor may rely on the technical or professional capacities of entities making resources available, irrespective of the legal nature of its legal relationships with them. The entity on whose resources the Contractor relies to demonstrate compliance with the conditions for participation in the procedure may not be subject to exclusion pursuant to Article 108(1) of the Act. 7. A Contractor that relies on the capacities or situation of entities making resources available shall submit, together with the tender, the commitment of the entity making resources available to place the necessary resources at its disposal for the purposes of performing the contract concerned, or another entity-related means of evidence confirming that, when performing the contract, the Contractor will have the necessary resources of those entities at its disposal. 8. If the technical or professional capacities of the entity making resources available do not confirm the Contractor’s compliance with the conditions for participation in the procedure, or if grounds for exclusion apply to that entity, the Contracting Authority shall require the Contractor, within the time limit specified by the Contracting Authority, to replace that entity with another entity or entities, or to demonstrate that it independently meets the conditions for participation in the procedure. 9. Instead of the relevant entity-related means of evidence specified in the SWZ, the Contractor may submit or rely on the certificate referred to in Article 124(2) of the Pzp Act, within the scope of certification of the absence of grounds for exclusion. 10. The Contractor shall provide information concerning the certificate in accordance with the SWZ requirements, in the tender form and in the JEDZ. 11. If the Contractor indicates that it uses a certificate, the Contracting Authority shall first verify the validity and scope of the certificate in the public procurement contractor certification database. 12. If the certificate does not cover all grounds for exclusion or conditions for participation in the procedure required in the SWZ, the Contractor shall demonstrate the remaining circumstances by submitting the relevant entity-related means of evidence at the request of the Contracting Authority. 13. If the Contractor indicated that it would use a certificate but did not provide information enabling its unambiguous identification, the Contracting Authority shall request the Contractor to submit entity-related means of evidence under the general rules. Following the request, the Contractor may rely on the certificate by providing information unambiguously identifying the certificate. 14. The Contractor is responsible for unambiguously indicating the scope within which it uses the certificate. If the Contractor’s declaration, the certificate or the information disclosed in the certification database does not show that the certificate covers a particular ground for exclusion or a particular condition for participation in the procedure, the Contracting Authority shall request the submission of entity-related means of evidence in this regard. 15. The certificate shall have effect only to the extent that it confirms the absence of grounds for exclusion required by the Contracting Authority in the SWZ. 16. Contractors applying jointly for the award of the contract may use a joint certificate within the scope of certification of Contractors’ capacity. 17. A joint certificate of a Contractor’s capacity may be used only by the Contractors that were jointly granted certification, and only where those same Contractors jointly apply for the award of the contract. 18. If the Contractor relies on the capacities of an entity making resources available, that entity may, under the rules specified above for the Contractor, demonstrate the absence of grounds for exclusion by means of the certificate referred to in Article 124(2) of the Pzp Act – in the same manner as the Contractor.
