Opportunity description

1. The subject matter of the contract is the production and delivery of an eco-friendly, reusable NON-WOVEN bag intended for promotional activities, bearing the logo of the nationwide social campaign entitled “Your blood, my life” with the website address www.twojakrew.pl, the logo of the Ministry of Health, the logo of the National Blood Centre, and the slogan: “We are united by blood that saves lives, Because goodness pulses within us”, in a quantity of 10,000 units. 2. The purchase is being carried out under the health policy programme of the minister responsible for health entitled “Ensuring the self-sufficiency of the Republic of Poland in blood and its components for the years 2021–2026”, within the scope of the specific objectives “Maintaining a constant number of informed donors of blood and its components”, “Increasing public awareness of voluntary blood donation”, and “Increasing awareness of healthy nutrition among blood donors”. 3. The contract must be performed in accordance with the requirements set out in the Terms of Reference (hereinafter the SWZ), OPZ, Draft Contractual Provisions (hereinafter the PPU), and the remaining tender documentation. 1. The subject matter of the contract is the production and delivery of an eco-friendly, reusable NON-WOVEN bag intended for promotional activities and distribution among Voluntary Blood Donors, bearing, among other things, the logo of the nationwide social campaign entitled “Your blood, my life” with the website address www.twojakrew.pl, the logo of the Ministry of Health, and the logo of the National Blood Centre, in a quantity of 10,000 units, in accordance with all requirements and conditions for contract performance specified in the Description of the Subject Matter of the Contract (hereinafter: OPZ), which constitutes an annex to the SWZ. 2. The Contracting Authority reserves the right to reduce the purchase, but by no more than 20% of the total of each part of the subject matter of the contract. The Contracting Authority is entitled, but not obliged, to exercise the option right consisting of reducing the quantity of the assortment covered by the subject matter of the contract, under the terms and according to the procedure described in § 11 of the PPU. 3. Pursuant to Article 255 point 3 of the Pzp Act, the Contracting Authority may cancel the public procurement procedure if the price or cost of the most advantageous Tender, or the Tender with the lowest price for the basic contract, exceeds the amount that the Contracting Authority intends to allocate to finance the contract. 4. Pursuant to Article 256 of the Pzp Act, the Contracting Authority may cancel the procurement procedure, as applicable, before the deadline for submitting Tenders if circumstances arise that render the continued conduct of the procedure unjustified. 5. Pursuant to Article 257 of the Pzp Act, the Contracting Authority provides for the possibility of cancelling the public procurement procedure if the funds that it intended to allocate to finance all or part of the contract have not been awarded to it. 1.8. The contract must be performed in accordance with the requirements set out in this SWZ, the OPZ, and the PPU. 1.9. The detailed delivery allocation, including the division of the quantity to be provided to Direct Recipients, constitutes an integral part of the contract and will be provided to the Contractor at the contract-signing stage. 2. SUBJECT-MATTER EVIDENCE: 2.1. Pursuant to Articles 105 and 106 of the Pzp Act, in order to confirm that the offered deliveries comply with the requirements, characteristics, or criteria specified in the description of the subject matter of the contract, the Tender evaluation criteria, or requirements related to contract performance, the Contracting Authority requires Contractors to submit: 2.1.1. One (1) unit of the subject matter of the contract in the form of an unmarked sample meeting all requirements specified by the Contracting Authority in the OPZ. 2.1.2. A specification sheet confirming the type and grammage of the material from which the bag was made and the type and grammage of the material from which the bag handles (2 pieces) were made. 2.2. Pursuant to Article 107(1) of the Pzp Act, the Contractor is required to submit the subject-matter evidence referred to above in point 2.1.2. together with the Tender via the Contracting Authority’s Procurement Platform, bearing a qualified electronic signature of a person authorised to represent the Contractor; however, where the samples of the offered subject matter of the contract listed in point 2.1.1. must be delivered together with the Tender, the Contracting Authority requires them to be delivered to the registered office of the entity conducting the procedure, i.e. the Public Procurement Department at the Ministry of Health, Al. Jerozolimskie 155, 02-326 Warsaw, during working hours on business days (Monday to Friday, 09:00–15:00) – by the deadline for submitting Tenders. 2.3. After the evaluation has been conducted, the samples will be returned at the Contractor’s request pursuant to Article 77 of the Pzp Act, taking into account Chapter II point 11 of the SWZ. 2.4. If the subject-matter evidence listed in point 2.1.2. is not enclosed with the Tender, the Contracting Authority, pursuant to Article 107(2) of the Pzp Act, provides for the possibility of supplementing the aforementioned subject-matter evidence once, within a deadline specified by the Contracting Authority. 2.5. Pursuant to Article 107(3) of the Pzp Act, the Contracting Authority does not provide for the possibility of supplementing the subject-matter evidence listed in point 2.1.1., because this subject-matter evidence will serve to confirm compliance with the characteristics or criteria specified in the description of the Tender evaluation criteria, in accordance with Chapter IX of the SWZ. 2.6. The subject-matter evidence referred to above shall be submitted in the manner provided for in the provisions issued pursuant to Article 70 of the Pzp Act – i.e. in the Regulation of the President of the Council of Ministers of 30 December 2020 on the manner of preparing and transmitting information and the technical requirements for electronic documents and means of electronic communication in a public procurement procedure or competition. 2.7. Pursuant to Article 65(1) point 4 of the Pzp Act, the Contracting Authority waives the use of electronic means of communication with respect to samples of the subject matter of the contract and permits their delivery through a postal operator within the meaning of the Act of 23 November 2012 – Postal Law (Journal of Laws of 2025, item 366), in person, or by courier. The method of their submission has been described above. 2.8. If the Contractor fails to submit the subject-matter evidence within the deadline specified by the Contracting Authority, the Contracting Authority will reject the Tender pursuant to Article 226(1) point 2(c) of the Pzp Act. 2.9. Pursuant to Article 107(1) of the Pzp Act, the Contractor is required to submit the aforementioned subject-matter evidence together with the Tender and should exercise all due diligence to ensure that these documents are complete and contain all necessary information enabling the Contracting Authority to verify their correctness. 2.10. Subject-matter evidence drawn up in a foreign language shall be submitted together with a translation into Polish. There is no obligation to translate into Polish proper names, commonly used technical terminology, trademarks, trade names, or indications of the origin of goods. Procedure: open.
