1 The procedure for the award of this public contract is conducted pursuant to the provisions of the Act of 11 September 2019, Public Procurement Law – hereinafter referred to as the “Pzp Act” – and the implementing provisions issued thereunder, in particular the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on entity-related evidence and other documents or statements that the Contracting Authority may require from the Contractor – hereinafter referred to as the “MR Regulation” – under an open procedure. 2 Pursuant to Article 139 of the Pzp Act, the Contracting Authority will first examine and evaluate the tenders and will then perform the entity qualification of the Contractor whose tender is rated highest, with regard to the absence of grounds for exclusion from the procedure and fulfilment of the conditions for participation. 3 Pursuant to Article 257 of the Public Procurement Law, the Contracting Authority reserves the right to cancel this procedure if the funds that the Contracting Authority intended to allocate to finance all or part of this contract are not granted to it. In the event of cancellation on the basis of the aforementioned grounds, Contractors shall not be entitled to reimbursement of the costs of participation in the procedure. 4. The Contractor shall remain bound by the submitted tender until 26.10.2026. The tender validity period shall commence upon expiry of the deadline for submission of tenders. 5. Contractors who meet the following conditions for participation in the procedure may participate in the procedure: with regard to technical or professional capacity: a) concerning experience in performing similar services. The Contractor must demonstrate that it has performed – no earlier than within the last five (5) years before the expiry of the deadline for submission of tenders in the procedure, or, if the period of conducting business activity is shorter, within that period – one (1) service (agreement) covering the modernization of the ASTKZ system for a gross amount of PLN 500,000.00 under a single contract. NOTE: In order to confirm fulfilment of the condition specified in point 7.3.4(a) of the SWZ, the Contractor may rely on an agreement (contract/task) that has not yet been completed and that covers the scope provided for in the condition, provided that it proves that, by the deadline for submission of tenders, the service specified in the condition has been completed and accepted.” NOTE: The Contracting Authority shall deem modernization to mean works jointly comprising the replacement, installation and configuration of elements of the existing automatic dam monitoring system. 6. The Contracting Authority requires the Contractor to conduct a site visit. a) each Contractor wishing to participate in the site visit is obliged to inform the Contracting Authority in writing in advance of its intention to participate in the site visit. The information should be sent to the Contracting Authority’s representatives, Mr Grzegorz Wesołowski, e-mail:grzegorz.wesolowski@wody.gov.pl, or Mr Patryk Majerski, e-mail:patryk.majerski@wody.gov.pl, to arrange the date and time of arrival, b) it is recommended that, as part of the site visit conducted, the Contractor prepare, inter alia, photographic documentation of the existing condition of the site, c) minutes of the visit shall be drawn up (signed by representatives of the Contractor and the Contracting Authority) in 2 identical copies (the 1st for the Contracting Authority, the 2nd for the Contractor). It is recommended that a copy of the minutes be attached to the tender as confirmation that the site visit was conducted. The template minutes constitute Annex No 11 to the SWZ. The Contracting Authority shall reject a tender submitted without a site visit having been conducted. d) the written information referred to in point a) above must be provided to the Contracting Authority no later than 5 calendar days before the proposed date of the visit, subject to the obligation to conduct the visit before the expiry of the deadline for submission of tenders. 1 The subject matter of the contract is the modernization of the existing ASTKZ system at the Włocławek Barrage. The Contractor shall modernize the existing Automatic Dam Technical Monitoring System within the following scope: 1.1 Delivery, replacement, installation and configuration of the main servers (S1, S2), including software and data migration – 2 units (OPZ points 4.1.1 and 4.1.3). 1.2 Delivery, replacement, installation and configuration of the access server (S3), including software and data migration – 1 unit (OPZ points 4.1.2 and 4.1.3). 1.3 Delivery, installation and configuration of the SCADA IT system software in the ASIX environment, supervising the operation of the entire ASTKZ system. Transfer of historical data and configuration of terminal units for operation in the new SCADA system – 1 complete set for ASTKZ (OPZ point 4.2). 1.4 Delivery, replacement, installation and configuration of operator stations (terminals), including software – 4 units (OPZ point 4.3). 1.5 Delivery, replacement and configuration of UPS power supplies (uninterruptible power supplies), including batteries, in the server room and in the data collection cabinets – 5 sets (OPZ point 4.4). 1.6 Delivery and replacement of 5 32-channel multiplexers, including their configuration on the sensor and server sides (OPZ point 4.5). 1.7 Expansion of the ASTKZ system with a drainage flow measurement system at the Włocławek Barrage dam, including integration with the SCADA system (OPZ point 4.6). 1.8 Extension of the firewall licence (OPZ point 4.7). 1.9 Expansion of the ASTKZ system with a water lock gate segment tilt measurement system (OPZ point 4.8). 1.10 Preparation of as-built documentation for the modernization of the ASTKZ system. All elements of the ASTKZ system modernization included within the scope of the task must ensure the efficient operation of the entire system and be integrated with elements of the old system (OPZ point 4.9). 1.11 Disposal of components (OPZ point 4.10). 1.12 Detailed descriptions of the subject matter of the contract are contained in the Description of the Subject Matter of the Contract and the draft contractual provisions (Annex No 6) Procedure: open.
