Opportunity description

1. The subject matter of the public contract is the supply of laboratory equipment, auxiliary equipment, and equipment for collecting and transporting samples for the Provincial Sanitary and Epidemiological Station in Rzeszów (Sanok Location) – Contract divided into 6 packages (parts). 2. A detailed description of the subject matter of the contract and detailed requirements concerning individual products upon delivery are specified in the annexes: Annex No. 1a Description of the Subject Matter of the Contract for Package No. 1, Annex No. 1b Description of the Subject Matter of the Contract for Package No. 2, Annex No. 1c Description of the Subject Matter of the Contract for Package No. 3, Annex No. 1d Description of the Subject Matter of the Contract for Package No. 4, Annex No. 1e Description of the Subject Matter of the Contract for Package No. 5, Annex No. 1f Description of the Subject Matter of the Contract for Package No. 6. 3. The subject matter of the contract includes the delivery of new and fully operational items compliant with the requirements specified in the procurement documents to the locations indicated in the Draft provisions of the public procurement contract. 4. The provisions of the draft provisions of the public procurement contract supplement the description of the subject matter of the contract. 5. The Contractor may entrust the performance of part of the contract to a subcontractor (subcontractors). 6. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. 7. The Contracting Authority requires the Contractor to indicate in the ESPD (Part II, Section D) the parts of the Subject Matter of the Contract that it intends to entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 8. If the performance of part of the subject matter of the contract is entrusted to Subcontractors, the Contracting Authority does not require the submission of ESPDs concerning those Subcontractors, except where a subcontractor is also an entity on whose resources the Contractor relies. 9. Failure to indicate the scope of subcontracting will be deemed a declaration, at the tender submission stage, that the Contractor that submitted the Tender will perform the Contract independently. 10. The Contracting Authority provides for the application of the so-called reverse procedure referred to in Art. 139(1) of the Public Procurement Law, i.e. the Contracting Authority will first examine and evaluate the tenders and then perform the qualitative selection of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 11. The Contracting Authority neither provides for the possibility nor requires submission of a tender after conducting a site visit or examining procurement documents held by the Contracting Authority that will be made available to entities expressing an interest in participating in the procedure. 12. The Contracting Authority reserves the right to cancel the procurement procedure if the public funds that the Contracting Authority intended to allocate to financing all or part of the contract are not granted to it. 13. To confirm fulfilment of the conditions for participation in the procedure and demonstrate the absence of grounds for exclusion, the Contractor is required, in accordance with the instructions referred to in Chapter XV of these SWZ, to submit an ESPD, whereby the ESPD must be submitted electronically under pain of invalidity, and the file must bear a qualified electronic signature. 14. If Contractors jointly apply for the contract, each of the Contractors jointly applying for the contract must, under pain of invalidity, submit an ESPD electronically, bearing a qualified electronic signature. These declarations confirm the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure to the extent that each Contractor demonstrates fulfilment of the conditions for participation in the Procedure. 15. The Contracting Authority does not require a bid bond. 16. The Contracting Authority does not require a performance bond. 17. All information not included in the contract notice but relevant to the procedure is contained in the SWZ – Contractors are requested to familiarise themselves thoroughly with its contents. 18. Detailed information on personal data protection is contained in the annex to the SWZ - GDPR Clause. 19. The contract is co-financed from funds from the Population Protection and Civil Defence Programme for 2025-2026. 1. Package 1 (part) Gamma, beta and X-ray radiation meter with an ionisation chamber. 2. Gamma, beta and X-ray radiation meter resistant to a high degree of air humidity in the working environment, min. 80% air humidity, and adapted to operate at temperatures from a minimum of -20 ͦ C to +40ͦ C, with the meter housing made of durable. 3. A detailed description of the subject matter of the contract and detailed requirements concerning individual products upon delivery are specified in Annex No. 1a Description of the Subject Matter of the Contract for Package No. 1. 4. (Applies to all parts of the contract) At the request of the Contracting Authority, in order to confirm the absence of grounds for exclusion, the Contractor whose tender receives the highest evaluation will be required to submit, within a specified period of no less than 10 days, the following entity-specific means of evidence: 1) information from the National Criminal Register within the scope of: a) Art. 108(1)(1) and (2) of the Public Procurement Law, concerning: natural persons, serving members of a management body or supervisory body (in particular members of management boards and members of supervisory boards), commercial proxies, partners in a general partnership or professional partnership, general partners in a limited partnership or limited joint-stock partnership), b) Art. 108(1)(4) of the Public Procurement Law (concerning: collective entities), - issued no earlier than 6 months before its submission and current as at the date of its submission. 2) a declaration by the Contractor, within the scope of Art. 108(1)(5) of the Public Procurement Law, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (Journal of Laws of 2020, items 1076 and 1086), as another Contractor that submitted a separate tender, or a declaration that it belongs to the same capital group together with documents or information confirming that the tender was prepared independently of another Contractor belonging to the same capital group. The Contracting Authority will be entitled to refrain from requesting submission of the aforementioned declaration if only one tender is submitted in the procedure. A template of the declaration constitutes an annex to the SWZ, 3) an extract or information from the National Court Register or from the Central Register and Information on Economic Activity, within the scope of Art. 109(1)(4) of the Public Procurement Law, issued no earlier than 3 months before its submission, if separate provisions require entry in a register or records, 4) a declaration by the Contractor that the information contained in the declaration referred to in Art. 125(1) of the Public Procurement Law remains current with regard to the grounds for exclusion, and in the Declaration of the absence of grounds for exclusion pursuant to Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014), indicated by the Contracting Authority and referred to in: a) Art. 108(1)(3) of the Public Procurement Law, b) Art. 108(1)(4) of the Public Procurement Law, concerning a prohibition on applying for a public contract imposed as a preventive measure, c) Art. 108(1)(5) of the Public Procurement Law, concerning the conclusion of an agreement with other contractors aimed at distorting competition, d) Art. 108(1)(6) of the Public Procurement Law, e) Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014), as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 111, 8.4.2022), f) Art. 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security. A template of the declaration constitutes an annex to the SWZ. 5. Instead of entity-specific means of evidence, it may submit the certificate referred to in Art. 124(2) of the Public Procurement Law regarding non-exclusion. In such a situation, it indicates this in the ESPD. 1. Package 2 (part) LSC liquid scintillation counter. 2. LSC liquid scintillation counter together with a starter set of standards and auxiliary materials for determining β-emitting radionuclides (e.g. Sr-90, H-3, C-14 in water and food samples in the event of radiological incidents and as part of radiological monitoring. 3. A detailed description of the subject matter of the contract and detailed requirements concerning individual products upon delivery are specified in Annex No. 1b Description of the Subject Matter of the Contract for Package No. 2 (Applies to all parts of the procedure) 4. The tender must be submitted in the original, in Polish, prepared electronically under pain of invalidity and bearing a qualified electronic signature, via https://platformazakupowa.pl/ The tender and the Contractor's declarations must be signed by the person or persons authorised to represent the Contractor. Every document comprising the tender should be legible. In the tender form, the Contractor is required to indicate the manufacturer's name and the model or symbol or another distinctive designation identifying the product. NOTE: Failure to indicate in the tender (price form) the manufacturer's name and the model or symbol or another distinctive designation identifying the product (main device) will result in rejection of the tender (applies to each package/part of the contract). 5. The tender should be submitted in accordance with the tender form, the template of which constitutes an Annex to the SWZ, electronically, bearing a qualified electronic signature. 6. Together with the Tender, the Contractor should submit: 1) Power of attorney for the persons signing the tender or other documents submitted with the tender, if their authorisation does not arise directly from registration documents or free and publicly accessible databases, provided that the Contractor supplied data enabling access to those documents. The power of attorney must be prepared electronically in accordance with Chapter XI(5) of the SWZ. 2) Power of attorney to represent all Contractors jointly applying for the award of the contract (if applicable). The power of attorney must be prepared electronically in accordance with Chapter XI(5) of the SWZ. 3) Justification for classifying information as a trade secret, if applicable. 4) European Single Procurement Document (ESPD), referred to in Chapter XVI of the SWZ, electronically, bearing a qualified electronic signature. 5) ESPD for each Contractor submitting a joint tender (consortium) – if applicable. 6) Contractor's declaration of the absence of grounds for exclusion pursuant to Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014), as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 111, 8.4.2022). 7) Declaration of each Contractor submitting a joint tender (consortium) concerning the absence of grounds for exclusion pursuant to Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, 31.7.2014), as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine – if applicable. 8) Product-specific means of evidence referred to in Chapter X of the SWZ. 9. To complete the ESPD, the Contractor may use the template constituting an Annex to the SWZ, as recommended by the Contracting Authority. The ESPD may also be prepared using the tool available at: https://espd.uzp.gov.pl/, in which case, after selecting the option “I am a Contractor”, “Create a Response” must be selected and completed in accordance with the instructions in the ESPD tool. Once the ESPD has been prepared, the document must be saved in pdf format and signed with a qualified electronic Signature by persons authorised to represent the entity to which the ESPD relates. 10. The ESPD must be submitted via the Contracting Authority's Tender Platform together with the tender. This also applies to the ESPDs of entities referred to in Chapter XI of the SWZ. 11. Declarations of entities submitting joint tenders and entities providing resources, submitted on the ESPD form, should be signed with a qualified electronic signature by each of them to the extent that they confirm the circumstances referred to in Art. 57 of the Public Procurement Law. 12. The Contractor is required to complete the ESPD within the following scope – parts: II, III, IV (the Contractor completes only Section α; Sections A–D of Part IV are not required to be completed) and VI. 13. If the Contractor uses the certificate referred to in Art. 124 of the Public Procurement Law, it completes Part II, Section A of the ESPD within the scope of “information concerning entry in the official list of approved contractors or possession of an equivalent certificate (e.g. under a national (pre-)qualification system)”. The Contractor should provide data enabling:  identification of the certificate;  determination of the certifying entity;  location of the certificate in the database;  determination of the scope in which the contractor intends to use it. 14. The obligation to submit the ESPD electronically, bearing a qualified electronic Signature in the manner specified above, also applies to an ESPD submitted upon request pursuant to Art. 128(1) of the Public Procurement Law. 1. Package 3 (part) Two sets of probes for RayMon10 portable spectrometers; 2. Package 1 (part) Gamma, beta and X-ray radiation meter with an ionisation chamber. 2. The fume cupboard is necessary for preparing environmental samples for the radiochemical determination of the strontium-90 isotope in soil, water and green plants, an accredited method, and for the mineralisation of food products, carrying out food analyses involving fats using hexane and isooctane solvents and a vacuum evaporator. 3. A detailed description of the subject matter of the contract and detailed requirements concerning individual products upon delivery are specified in Annex No. 1d Description of the Subject Matter of the Contract for Package No. 4. 1. Package 1 (part) Gamma, beta and X-ray radiation meter with an ionisation chamber. 2. The muffle furnace is necessary for ashing environmental samples for the radiochemical determination of the strontium-90 isotope in soil, water and green plants. 3. A detailed description of the subject matter of the contract and detailed requirements concerning individual products upon delivery are specified in Annex No. 1e Description of the Subject Matter of the Contract for Package No. 5. 1. Package 1 (part) Gamma, beta and X-ray radiation meter with an ionisation chamber. 2. The dryer is necessary for drying environmental samples for the radiochemical determination of the strontium-90 isotope in soil, water and green plants. 3.
