1. The subject matter of the contract is a service consisting of carrying out emergency works on rivers and watercourses in the area of ZZ Kraków within: NW Bochnia, NW Brzesko, NW Kraków, NW Myślenice, NW Oświęcim and NW Proszowice. The contract has been divided into 7 parts: Part 1 - Emergency works on rivers and watercourses in the area of NW Bochnia Part 2 - Emergency works on rivers and watercourses in the area of NW Brzesko Part 3 - Emergency works on rivers and watercourses in the area of NW Kraków - right bank of the Vistula River Part 4 - Emergency works on rivers and watercourses in the area of NW Kraków - left bank of the Vistula River Part 5 - Emergency works on rivers and watercourses in the area of NW Myślenice Part 6 - Emergency works on rivers and watercourses in the area of NW Oświęcim Part 7 - Emergency works on rivers and watercourses in the area of NW Proszowice 2. The scope of works includes, among other things: • clearing the watercourse channel by removing blockages hindering the free flow of water (trunks, branches, limbs, deposited reinforcement elements, silt, debris), together with depositing the natural excavated material within the channel, • clearing the watercourse channel by removing blockages hindering the free flow of water (trunks, branches, limbs, rubbish, plastic bottles, packaging, films, deposited reinforcement elements, bricks, silt, debris, etc.), together with removal and disposal in accordance with applicable regulations, • removing beaver dams from river and watercourse channels, • emergency sealing of a levee sluice using film and sandbags in the event of flood surges, • emergency sealing of levees in the event of flood surges, • constructing biological reinforcement on the banks of rivers and watercourses in the form of flat brushwood bank protection, fascine fences and fascine sausage revetments, • filling bank breaches in river channels with delivered medium or coarse riprap stone • throughout the entire period of carrying out the works specified by the Contracting Authority, the Contractor is required to provide environmental supervision, the acceptance and settlement of which for the entire contract will take place upon final acceptance, • a report on the environmental supervision carried out for individual orders must be submitted to the Contracting Authority during partial acceptances. The detailed scope of the contract is contained in the tender cost estimates constituting annexes to the SWZ. 3. The Contracting Authority has provided for the possibility of exercising the option right. The contract covered by the option right consists of increasing the quantity of works included in the tender cost estimate, which may occur up to a maximum of 200% of the Contractor’s gross remuneration specified in § 3 sec. 1 of the concluded contract. The option right will be exercised according to the following rules: a) performance of the contract under the option takes place according to the rules applicable to the basic contract. From the moment the Contracting Authority exercises the option right, all provisions of the contract directly governing option matters and governing the manner of performance of the contract and the Contractor’s obligations in general shall apply to the subject matter of the contract awarded under the option. b) The Contracting Authority will submit to the Contractor a declaration, sent electronically to the e-mail address indicated by the Contractor in § 20 sec. 2 of the contract, on exercising the option right, specifying what the Contractor is to perform. The moment the declaration is submitted is the moment the option is activated. c) The Contracting Authority will submit to the Contractor the final declaration on exercising the option right no later than 5 days before the deadline specified in § 2 sec. 1 point 2 of the Contract. d) Settlement of the subject matter of the contract covered by the scope of the contract under the option right will take place on the basis of the unit prices specified in the tender cost estimate constituting Annex No. 1 to the Contract. e) The option right constitutes the exclusive entitlement of the Contracting Authority, and the Contractor shall have no claim for the exercise of this right by the Contracting Authority. The Contractor shall have no claim whatsoever against the Contracting Authority if the Contracting Authority does not exercise the option right. f) The Contractor shall not have the right to withdraw from performance of the option. The Contractor is required to perform the subject matter of the contract in full, i.e. both the basic contract and that covered by the option right. 4. The detailed scope of the contract and the standards and requirements for its performance are specified in the procurement documentation, including in particular the draft contract constituting Annex No. 1 to the SWZ, the Description of the subject matter of the contract and the tender cost estimate templates, which, with regard to the description of items and measurements, serve as bills of quantities for the works.
