Opportunity description
The subject matter of the contract is the supply of materials for cataract surgery, vitrectomy surgery, intraocular lenses, ophthalmic materials, and the lease of equipment for cataract surgery and posterior vitrectomy for a period of 24 months from the award of the contract (see: Description of the Subject Matter of the Contract (OPZ), constituting Appendix No. 2 to the SWZ, and Description of Technical Parameters – Appendix No. 3 to the SWZ). 4. Entity-related evidence required from the Contractor includes: 1) Information from the National Criminal Register concerning: a) Article 108(1)(1) and (2) of the Pzp Act, b) Article 108(1)(4) of the Pzp Act, concerning a ruling prohibiting participation in public procurement procedures as a penal measure, issued no earlier than 6 months before its submission. 2) A statement by the Contractor, within the scope of Article 108(1)(5) of the p.z.p. Act, that it does not belong to the same capital group, within the meaning of the Act of 16.02.2007 on Competition and Consumer Protection, as another contractor that submitted a separate tender, partial tender, or request to participate in the procedure, or a statement that it belongs to the same capital group, together with documents or information confirming that the tender, partial tender, or request to participate in the procedure was prepared independently of another Contractor belonging to the same capital group - Appendix No. 8 to the SWZ, 3) A statement by the Contractor confirming that the information contained in the statement referred to in Article 125(1) of the Pzp Act remains current, with respect to the grounds for exclusion from the procedure specified by the Contracting Authority, referred to in: a) Article 108(1)(3) of the Pzp Act, b) Article 108(1)(4) of the Pzp Act, concerning a ruling prohibiting participation in public procurement procedures as a preventive measure, c) Article 108(1)(5) of the Pzp Act, concerning the conclusion of an agreement with other Contractors intended to distort competition, d) Article 108(1)(6) of the Pzp Act, Appendix No. 5 to the SWZ. 4) A statement by the Contractor concerning the grounds for exclusion from the procedure referred to in Article 5k of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine. - Appendix No. 6 to the SWZ - Appendix No. 7 to the SWZ (if applicable). 5) A copy of or information from the National Court Register or the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the p.z.p. Act, issued no earlier than 3 months before its submission, if separate regulations require entry in a register or records, 6) A list of supplies comparable to the supplies constituting the subject matter of the contract, completed and, in the case of recurring or continuous services, also being performed, during the last 3 years, or, if the period of business activity is shorter, during that period, specifying their value, subject matter, performance dates, and the entities for which the supplies were completed or are being performed, together with evidence indicating whether those supplies were completed or are being performed properly, where the evidence referred to consists of references or other documents prepared by the entity for which the supplies were completed or, in the case of recurring or continuous services, are being performed, or, if for reasons beyond its control the Contractor is unable to obtain these documents – a statement by the Contractor; in the case of recurring or continuous services still being performed, references or other documents confirming their proper performance should have been issued within the last 3 months – in accordance with the condition specified in Chapter VIII, point 2.4) - Appendix No. 9 to the SWZ. To confirm that the Contractor meets the conditions for participation in the procedure: for the list of supplies specified in Chapter VIII. CONDITIONS FOR PARTICIPATION IN THE PROCEDURE, paragraph 2, subpoint 4), the Contractor is required to attach to the tender a preliminary statement in the form of a single document (Part IV, section α) – Appendix No. 4 to the SWZ, and the Contractor whose tender receives the highest rating must, at the request of the Contracting Authority, also submit documents confirming these circumstances: − The Contractor will meet the condition if it demonstrates that, during the last 3 years, or, if the period of business activity is shorter, during that period, it has properly completed at least 3 supplies consisting of supplies comparable to the supplies constituting the subject matter of the contract, with a minimum value for the individual tasks of: Package No. 1, parts No. 1 and 2: 2 049 810,00 Package No. 2: 319 140,00 Package No. 3: 202 791,00 Package No. 4: 282 521,00 Package No. 5, Task No. 1: 1 658,00 Package No. 5, Task No. 2: 1 166,00 Package No. 5, Task No. 3: 3 499,00 Package No. 5, Task No. 4: 2 219,00 Package No. 5, Task No. 5: 4 800,00 Package No. 5, Task No. 6: 2 667,00 Package No. 6: 27 993,00 Package No. 7: 5 443,00 Package No. 8: 24 883,00 gross for each supply. A Contractor submitting a tender for several tasks must demonstrate at least 3 supplies, completed and, in the case of continuous services, also being performed, with the required total value equal to the sum of the tasks covered by the tender.
