Name of the contract for partial task No. 1: “EXPANSION OF THE ŁÓDŹ PROPERTY MANAGEMENT SYSTEM DATABASE THROUGH THE INTEGRATION OF THE EN AND DOM5 SYSTEMS” for the project entitled: “City Management based on spatial databases together with the development of e-services” co-financed by the European Regional Development Fund under the regional programme European Funds for Łódzkie 2021-2027. Name of the contract for partial task No. 2: “EXPANSION OF THE ŁÓDŹ PROPERTY MANAGEMENT SYSTEM DATABASE IN ORDER TO LAUNCH NEW E-SERVICES” for the project entitled: “City Management based on spatial databases together with the development of e-services” co-financed by the European Regional Development Fund under the regional programme European Funds for Łódzkie 2021-2027. The detailed description and scope of the subject matter of the contract (hereinafter: “OPZ”) has been described for partial task No. 1 in Annex No. 1A and for partial task No. 2 in Annex No. 1B to the SWZ. The Contractor is obliged to perform the contract under the terms and conditions presented in the model Contract constituting Annex No. 4.1. to the SWZ /partial task No. 1/ and in the model Contract constituting Annex No. 4.2. to the SWZ /partial task No. 2/. 15.1. /numbering in accordance with the SWZ/ Contractors who: 15.1.1. Are not subject to exclusion pursuant to Art. 108(1) and 109(1) of the Pzp Act, Art. 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws, item 835), referred to as the “Sanctions Act”, and Art. 5k of Council Regulation (EU) No. 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No. L 229 of 31.7.2014, p. 1), as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No. 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No. L 111 of 8.4.2022, p. 1), referred to as the “Sanctions Regulation”, may apply for the award of the contract. 15.1.1. /numbering in accordance with the SWZ/Meet the conditions for participation in the procedure concerning: 15.1.2.1 capacity to conduct business activities: The Contracting Authority does not impose any conditions in this respect; 15.1.2.2 authorisation to conduct a specific business or professional activity, where required by separate regulations: The Contracting Authority does not impose any conditions in this respect; 15.1.2.3 economic or financial standing: Partial task No. 1 The Contractor will meet the condition if it demonstrates that it holds civil liability insurance covering the conducted activity related to the subject matter of the contract in an amount not less than PLN 250000.00 (in words: two hundred and fifty thousand zlotys) and has financial resources or creditworthiness in the amount of at least PLN 250000.00 (in words: two hundred and fifty thousand zlotys). Values stated in a currency other than PLN in documents confirming fulfilment of the condition referred to above will be converted into PLN according to the average exchange rate of the National Bank of Poland announced on the date of publication of the contract notice in the Public Procurement Bulletin. In partial task No. 2, the Contractor will meet the condition if it demonstrates that it holds civil liability insurance covering the conducted activity related to the subject matter of the contract in an amount not less than PLN 250000.00 (in words: two hundred and fifty thousand zlotys) and has financial resources or creditworthiness in the amount of at least PLN 250000.00 (in words: two hundred and fifty thousand zlotys).). Values stated in a currency other than PLN in documents confirming fulfilment of the condition referred to above will be converted into PLN according to the average exchange rate of the National Bank of Poland announced on the date of publication of the contract notice in the Public Procurement Bulletin. 15.1.2.4 technical or professional capacity: Partial task No. 1 A1)The Contracting Authority will consider the condition fulfilled if the Contractor demonstrates that, within the last 7 years counted backwards from the date on which the deadline for submission of tenders expires, and if the period of conducting business is shorter—within that period, it duly performed: - at least two contracts whose subject matter was the design, execution and implementation of software, a standalone module or its modernisation using SQL databases, related to interoperability with external software. At least one of these contracts must have been performed for a local government unit with a gross value of PLN 100 000.00 each. The value of the contracts performed, their subject matter, performance dates and the entities for which the supplies or services were performed must be provided, together with evidence specifying whether these services were or are being duly performed, whereby the evidence referred to shall be • references or other documents issued by the entity for which the supplies or services were performed, and, in the case of periodic or continuous services, are being performed, • and if, for a justified objective reason, the contractor is unable to obtain these documents—the contractor’s declaration; • in the case of periodic or continuous services still being performed, references or other documents confirming their due performance should be issued no earlier than 3 months before the deadline for submission of tenders or requests to participate in the procedure. * By one service, the Contracting Authority means a service performed under one contract. ** In the case of services in progress, the requirement concerning the duration of performance of a given service applies to the part of the contract already completed, i.e. from the date on which performance of the service began until the deadline for submission of tenders. Chapter XV of the SWZ) Partial task No. 1 4.1. /numbering in accordance with the SWZ/ The subject matter of the contract is the EXPANSION OF THE ŁÓDŹ PROPERTY MANAGEMENT SYSTEM DATABASE THROUGH THE INTEGRATION OF THE EN AND DOM5 SYSTEMS for the Project entitled: City Management based on spatial databases together with the development of e-services” co-financed by the European Regional Development Fund under the regional programme European Funds for Łódzkie 2021-2027”. 4.2. The subject matter of the contract is the preparation and implementation of a Solution that will enable integration between the EN and DOM5 systems with respect to municipal properties, State Treasury properties and properties without a regulated legal status. 4.3. The subject matter of the contract will be performed in the following successive stages: a. Stage I: i. conducting a pre-implementation analysis, ii. presenting the design to the Contracting Authority and obtaining its approval. The design must include a specification of the changes necessary to be made in the DOM5 and EN products. These works, as they depend on the possession of copyright, will be the subject of separate supplementary contracts addressed to companies holding such rights. b. Stage II: i. Supporting the Contracting Authority in preparing specifications for procedures addressed to elements of the Solution designed in Stage I, elements of the Solution, ii. participation in acceptance tests of the elements resulting from the presented design and performed by the Contractors of the supplementary contracts referred to in point ii of this paragraph, iii. execution, according to the prepared design, of the product constituting the central part of the Solution, iv. participation in acceptance tests of works performed under supplementary contracts, v. installation and configuration of the Solution in the Contracting Authority’s production environment, vi. conducting acceptance tests of the entire Solution, vii. provision of post-implementation documentation and licences c. Stage III: i. provision of Service and technical support services for the entire Solution. 4.4. The detailed description and scope of the subject matter of the contract (hereinafter: “OPZ”) has been described in Annex No. 1A to the SWZ. 4.5. The Contractor is obliged to perform the contract under the terms and conditions presented in the model Contract constituting Annex No. 4.1.to the SWZ. 4.6. The detailed scope of obligations concerning performance of the subject matter of the contract and the payment terms are specified in the Model contract constituting Annex No. 4.1. to the SWZ. 4.7. Throughout the entire service period, the Contractor is obliged to hold civil liability insurance and, on the date of conclusion of the contract, to submit to the Contracting Authority proof of its conclusion, the conditions of the insurer’s liability and proof of payment of the premium. 4.8. The contract will be performed in accordance with the “Material and financial work schedule”, which will be finally agreed by the Parties to the contract within no more than 14 calendar days from the date of signing the contract 4.9. Performance of the contract must be carried out with due diligence and in accordance with all requirements contained in the SWZ with annexes and any Information for Contractors.
