1. The subject of the procedure is the conclusion of a Framework Agreement for the selection of intermediaries in obtaining and supplying to the Units all types of licenses, including in the form of subscriptions for the Manufacturer's VMware software or equivalent software, indicated in the Manufacturer's Price List, within the product categories indicated in Appendix No. 1A to the SWZ, together with technical support, as well as the provision of the Manufacturer's Expert Support Services and the Contractor's Consulting Support Services concerning the supplied Manufacturer's software. 2. The purpose of the Framework Agreement is to establish the terms and conditions concerning contracts (performed on the basis of specific contracts) that may be awarded during the term of the Framework Agreement indicated in Chapter IV of the SWZ. 3. The Framework Agreement specifies all conditions concerning the performance of supplies or the provision of Services and the conditions for selecting Contractors who will perform the supplies or provide the Services for the benefit of the Units, from among the Contractors that are parties to the Framework Agreement. 4. Contracts will be performed successively, depending on the needs of the Units, after the Unit has conducted the Specific Procedure – i.e. the Unit has submitted a Contract Request, the Contractor has submitted a response to the Contract Request, and the Contractor that will perform the given contract has been selected. 5. The list of Units that may award contracts or for whose benefit contracts may be awarded constitutes Appendix No. 8 to the SWZ. 6. Pursuant to Article 134(2)(7) of the Pzp Act, the Contracting Authority indicates that it will conclude the Framework Agreement with a maximum of three Contractors (unless fewer Contractors submit tenders that are not subject to rejection) who obtain the highest number of points in the evaluation of tenders, based on the criteria specified in the SWZ, and whose tender price does not exceed the amount allocated to finance the Framework Agreement, provided that the Contracting Authority may increase this amount. If the balance of points obtained is the same for several Contractors, the Contracting Authority will conclude the Framework Agreement with all Contractors. 7. The subject of the contract performed under Specific Contracts concluded on the basis of the Framework Agreement consists of the following categories of Products together with Services, specified in Appendix No. 1A to the SWZ – Price Form and in Appendix No. 2A to the SWZ – Illustrative List of Products and Services: 1) Subscriptions – available each time in the current Manufacturer's Price List; 2) Licenses acquired for a period shorter than that indicated in the Manufacturer's Price List (concerning the alignment of support periods for licenses) – available each time in the current Manufacturer's Price List; 4) Manufacturer's Expert Support Services – specified in point I.4 of the Description of the Subject Matter of the Contract constituting Appendix No. 2 to the SWZ – available each time in the current Manufacturer's Price List; 4) Contractor's Consulting Support Services – specified in point I. 5 of the Description of the Subject Matter of the Contract constituting Appendix No. 2 to the SWZ; 8. The meaning of the terms used in the SWZ is identical to the definitions adopted in the model Framework Agreement (Appendix No. 5 to the SWZ) and the model Specific Contract (Appendix No. 5A to the SWZ). 1.
