1. The subject matter of the contract is: Supply of small laboratory equipment for the organizational units of the Wroclaw Medical University named after the Silesian Piasts. The subject matter of the contract is described in detail in the Technical Information Sheet (Appendix No. 2, Lots 1–9, to the SWZ). The Contracting Authority requires the products offered to meet the requirements contained in the Technical Information Sheet. The detailed terms and conditions governing performance of the contract are set out in the Draft Contract (Appendix No. 4 to the SWZ). 3. When describing the subject matter of the contract, the Contracting Authority specified the manufacturer’s name and the catalogue numbers of the laboratory equipment in order to indicate the product quality standards and precisely define the subject matter of the contract. In cases where the description of the subject matter of the contract indicates trademarks, patents or origin, sources or a particular process that characterizes the products supplied by a specific Contractor, this means that the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise and comprehensible manner. In such situations, any references to trademarks, patents, origin, source or particular process must be read together with the words “or equivalent.” 4. Pursuant to Article 99(6) of the Pzp, the Contracting Authority permits the submission of equivalent tenders, i.e. tenders with parameters and properties no worse than those specified by the Contracting Authority in the Technical Information Sheet, Appendix No. 2 to the SWZ (Lots 1–9). 5. If offering a product other than that specified by the Contracting Authority, the Contractor is obliged to demonstrate in the tender that the supplies it offers meet the requirements specified by the Contracting Authority by providing, as appropriate, in the Assortment and Price Form constituting Appendix No. 3 to the SWZ (Lots 1–9), the name of the product offered, the manufacturer’s name and the catalogue number, or other characteristics that unambiguously identify the products offered. Equivalent products must: 1) Have the composition and characteristics of the laboratory equipment specified in Appendix No. 2 to the SWZ (Lots 1–9), 2) Have the packaging capacity and weight of the laboratory equipment indicated in Appendix No. 2 to the SWZ (Lots 1–9), 3) Have a warranty period no shorter than that of their counterparts in Appendix No. 2 to the SWZ (Lots 1–9). 6. Time limit for performance of the subject matter of the contract for each lot – max. 21 working days from the date of signing the contract.
