1. Subject matter of the contract 1) The subject matter of the contract is the sale and delivery of an Artificial Intelligence Applications in Logistics Laboratory for the Maritime University of Szczecin. The detailed description of the subject matter of the contract and the description of the contracting authority’s requirements regarding performance and acceptance are specified in: - description of the subject matter of the contract – Annex No. 1a to the SWZ, - draft contractual provisions specified in the model contract constituting Annex No. 3 to the SWZ. All requirements specified in the documents indicated above constitute minimum requirements, and compliance with them is mandatory. Failure to meet the above-mentioned minimum requirements will result in rejection of the tender as non-compliant with the procurement conditions pursuant to Art. 226(1)(5) of the Pzp Act. 3) CPV nomenclature: 38000000-5 Laboratory, optical and precision equipment (excl. glasses) 38500000-0 Checking and testing apparatus 4) Any names (trademarks) provided by the Contracting Authority are examples, and their indication is intended to define the expected standard, while the Contracting Authority permits the submission of equivalent tenders with regard to the prepared description of the subject matter of the contract. 5) The subject matter of the contract has been defined by indicating objective technical and quality characteristics and standards, for the specification of which the indication of example trademarks is permitted. 6) Where the Contracting Authority refers in the description of the subject matter of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101(1)(2) and (3) of the Pzp Act, solutions equivalent to those described are permitted. 7) The Contracting Authority requires that the subject matter of the contract be brand new, free from technical and legal defects, of good quality, authorized for sale, packaged in the original packaging for the given product, and provided with labels identifying the given product and specifying its technical, quality, functional and operational parameters. The subject matter of the contract, as well as the packaging, must bear the company mark and an indication of origin (manufacturer). 8) The Contracting Authority does not permit the submission of partial tenders. 9) The Contracting Authority permits supplies or services to originate from countries other than Member States of the European Union and countries that are parties to the World Trade Organization Agreement on Government Procurement or parties to other international agreements guaranteeing, on the basis of reciprocity and equality, access to the public procurement market, to which the European Union is a party, hereinafter referred to as “third countries not party to international agreements.” 2. Equivalent solutions A Contractor relying on equivalent solutions is required to demonstrate that the solution it offers meets the requirements specified by the contracting authority. In such a case, the contractor shall attach to the tender a list of equivalent solutions together with their description or standards. Procedure: open. Estimated value: 1,143,000 PLN.
