1. This procedure is conducted as an open tender pursuant to the Act of 11 September 2019, Public Procurement Law, hereinafter referred to as the “PPL Act or PPL,” and these Specifications of the Terms of Contract
Opportunity description
1. This procedure is conducted as an open tender pursuant to the Act of 11 September 2019, Public Procurement Law, hereinafter referred to as the “PPL Act or PPL,” and these Specifications of the Terms of Contract, hereinafter referred to as the “SWZ.” 2. The estimated value of the contract exceeds the amount specified in the notice of the President of the Public Procurement Office issued pursuant to Art. 3(2) PPL. 3. The Contracting Authority envisages applying the so-called reverse procedure referred to in Art. 139(1) of the PPL Act, i.e. the Contracting Authority will first examine and evaluate the tenders and will then assess the eligibility of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 4. The Contracting Authority permits the submission of tenders for parts. The subject matter of the contract has been divided into six (parts/tasks): Package 1 (part) Supply of Sealers and a UV Lamp; Package 2 (part) Supply of Incubators; Package 3 (part) Supply of steam, vertical autoclaves with accessories; Package 4 (part) Supply of a Class II microbiological safety laminar flow cabinet; Package 5 (part) Supply of electric, compressor-type car refrigerators. 5. A detailed description of the subject matter of the contract and detailed requirements concerning the individual products to be supplied are set out in the annexes: Annex No. 1a Description of the Subject Matter of the Contract for Package No. 1, Annex No. 1b Description of the Subject Matter of the Contract for Package No. 2, Annex No. 1c Description of the Subject Matter of the Contract for Package No. 3, Annex No. 1d Description of the Subject Matter of the Contract for Package No. 4, Annex No. 1e Description of the Subject Matter of the Contract for Package No. 5. 6. The subject matter of the contract comprises the delivery of a new and fully operational assortment compliant with the requirements specified in the procurement documents to the locations indicated in the Draft provisions of the public procurement contract. 7. The Contractor may entrust the performance of part of the contract to a subcontractor (subcontractors). 8. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. 9. The Contracting Authority requires the Contractor to indicate in the JEDZ (Part II, Section D) the parts of the Subject Matter of the Contract that it intends to entrust to Subcontractors and to name any Subcontractors, if already known. 10. If performance of part of the subject matter of the contract is entrusted to Subcontractors, the Contracting Authority does not require the submission of JEDZ forms concerning those Subcontractors, except where a subcontractor is also an entity on whose resources the Contractor relies. 11. Failure to indicate the scope of subcontracting will be deemed a declaration, at the tender submission stage, that the Contract will be performed independently by the Contractor that submitted the Tender. 12. The Contracting Authority neither provides for the possibility of nor requires submission of a tender following a site visit or examination of procurement documents held by the Contracting Authority that will be made available to entities expressing an interest in participating in the procedure. 13. The contract is co-financed with funds from the Population Protection and Civil Defence Programme for 2025-2026. 14. The Contracting Authority reserves the right to cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to financing all or part of the contract are not awarded to it. 13. To confirm fulfilment of the conditions for participation in the procedure and demonstrate the absence of grounds for exclusion, the Contractor is required, in accordance with the instructions referred to in Chapter XV of this SWZ, to submit a JEDZ, whereby the JEDZ must, under pain of invalidity, be submitted in electronic form and the file must bear a qualified electronic signature. 14. Where Contractors jointly apply for the contract, a JEDZ in electronic form bearing a qualified electronic signature must, under pain of invalidity, be submitted by each of the Contractors jointly applying for the contract. These declarations confirm the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure to the extent that each Contractor demonstrates fulfilment of the conditions for participation in the Procedure. 15. The Contracting Authority does not require a tender security deposit. 16. The Contracting Authority does not require a performance bond. 17. All information not included in the contract notice that is material to the procedure is contained in the SWZ – Contractors are requested to familiarise themselves with its contents in detail. 18. (Applies to all parts of the contract) At the request of the Contracting Authority, in order to confirm the absence of grounds for exclusion, the Contractor whose tender receives the highest evaluation will be required to submit the following entity-specific evidence within the prescribed period, which shall not be shorter than 10 days: 1) information from the National Criminal Register concerning: a) Art. 108(1)(1) and (2) of the PPL Act, applies to: natural persons, serving members of a management body or supervisory body (in particular members of management boards and members of supervisory boards), commercial proxies, partners in a general partnership or professional partnership, and general partners in a limited partnership or partnership limited by shares), b) Art. 108(1)(4) of the PPL Act (applies to: collective entities), - drawn up no earlier than 6 months before its submission and current as at the date of its submission. 2) a declaration by the Contractor, within the scope of Art. 108(1)(5) of the PPL Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection (Journal of Laws of 2020, items 1076 and 1086), as another Contractor that submitted a separate tender, or a declaration that it belongs to the same capital group, together with documents or information confirming that the tender was prepared independently of another Contractor belonging to the same capital group. The Contracting Authority will be entitled to refrain from requesting submission of the above declaration if only one tender is submitted in the procedure.
