The subject matter of the contract has been divided into 3 (three) parts, evaluated separately, i.e.: Part 1 – Successive supply of reagents from: 10XGenomiscs, Ilumina, Magtivio or equivalent for the Units of the Wroclaw Medical University named after the Silesian Piasts; The above-mentioned reagents belong to group 6 (i.e. Basic chemical compounds for laboratory applications); Part 2 – Successive supply of reagents from Bio-merieux or equivalent for the Units of the Wroclaw Medical University named after the Silesian Piasts; The above-mentioned reagents belong to group 1 (i.e. Cell biology reagents) and group 5 (i.e. Detection and diagnostic reagents); Part 3 – Successive supply of reagents from Capricorn Scientific or equivalent for the needs of the Units of the Wroclaw Medical University named after the Silesian Piasts; The above-mentioned reagents belong to group 4 (i.e. Reagents for the isolation, detection and labelling of molecules). The subject matter of the contract has been described in detail in terms of quantity and type in the Assortment and Pricing Sheet (Appendix No. 2, Parts 1–3, to the SWZ). However, the quantities specified in the Sheet constitute only a forecast needed for comparing tenders. During the performance of the contract, the Contracting Authority will order reagents in quantities corresponding to the User’s actual needs. The Contracting Authority reserves the right not to use the entire contract amount, provided that the Contracting Authority guarantees the Contractor the performance of supplies with a value of no less than 40% of the contract amount. In describing the subject matter of the contract, the Contracting Authority specified the manufacturer’s name and the catalogue numbers of the reagents in order to indicate the product quality standards and precisely define the subject matter of the contract. This is necessary because the research conducted by the Contracting Authority is a continuation of scientific research carried out in the Contracting Authority’s units. To maintain the continuity and uniformity of the research and ensure reliable results, the Contracting Authority is required to ensure supplies of the reagents with which this research was commenced. In cases where the description of the subject matter of the contract indicates trademarks, patents or origin, source or a particular process that characterises products supplied by a specific Contractor, this means that the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise and comprehensible manner. In such situations, any references to trademarks, patents, origin, source or a particular process must be read together with the words “or equivalent.” In accordance with Art. 99(6) of the Pzp, the Contracting Authority permits the submission of equivalent tenders, i.e. tenders for reagents with parameters and properties no worse than those specified by the Contracting Authority in Appendix No. 2 to the SWZ (Parts 1–3). Where a product other than that specified by the Contracting Authority is offered, the Contractor is required to demonstrate in the tender that the supplies it offers meet the requirements specified by the Contracting Authority by providing, as applicable, in the Assortment and Pricing Sheet, Appendix No. 2 to the SWZ (Parts 1–3), the name of the offered product, the manufacturer’s name and catalogue number, or other characteristics that unambiguously identify the offered products. Equivalent reagents must: 1) Be characterised by a high degree of purity and a chemical composition guaranteeing correct determinations and allowing the continuation of scientific research; 2) Have the same composition and characteristics as the reagents specified in Appendix No. 2 to the SWZ (Parts 1–3), in accordance with the equivalence description indicated in that appendix; 3) Have the same packaging capacity and weight as the reagents indicated in Appendix No. 2 to the SWZ (Parts 1–3); 4) Have a warranty period no shorter than that of their counterparts in Appendix No. 2 to the SWZ (Parts 1–3). The Contractor will perform the subject matter of the contract successively, in quantities resulting from the Contracting Authority’s current needs, each time within the period specified by the Contractor in the tender, not exceeding 50 working days (on days from Monday to Friday between 08:00 and 14:00, excluding public holidays) from the date the order is sent by email.
