Opportunity description
1. The subject matter of the contract is: Supply of Panels for detecting infectious pathogens and resistance mechanisms using the nmPCR method, together with the lease of two modules for the BioFire FilmArray Torch analyzer owned by ZMK of the Provincial Specialist Hospital, for a period of 24 months, for the Our Lady Provincial Specialist Hospital in Częstochowa. 2. The description of the subject matter of the contract is contained in the assortment and price forms constituting Appendix No. 2 to the SWZ. The remaining conditions concerning performance of the contract are set out in Appendix No. 6 to the SWZ, constituting the draft contractual provisions (PPU). 3. Reasons for not dividing the contract into lots: The subject matter of the contract has not been divided for organizational, technical, technological and economic reasons and for the rational expenditure of public funds. Dividing the contract into lots could result in restricted competition or excessive technical difficulties and contract performance costs, as well as the need to coordinate the activities of different contractors performing individual elements of the contract. Furthermore, there would be a risk that the full scope of the contract would not be performed. The Contracting Authority conducted market research, and contracts of this type are handled by companies specializing in this field. 4. The Contracting Authority requires that the offered provision, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service provision environment or accompanying solutions, must not include: • ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have an adverse impact on the fundamental interest of state security; • an ICT product whose type has been specified in the decision recognizing a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Article 226(1)(17) or (19) of the Pzp Act.
