Description of the Subject Matter of the Contract: 1. The subject matter of the contract is the supply of reagents and consumables together with the lease of analyzers, in accordance with the quantities and requirements contained in Annex No. 3 to this specification, “Detailed description of the subject matter of the contract”, divided into 6 tasks: Task No. 1 - Coagulation reagents together with the lease of an analyzer. Task No. 2 - Reagents and consumables together with the lease of an acid-base balance analyzer. Task No. 3 - Biochemical reagents and consumables together with the lease of an analyzer. Task No. 4 - Immunochemical reagents together with the lease of an analyzer. Task No. 5 - Urinalysis system. Task No. 6 - Reagents and consumables together with the lease of a 5-Diff hematology analyzer with reticulocytes. 2. Tenders not containing the full scope of the subject matter of the contract specified in Annex No. 3 to the specification for the individual tasks will be rejected. 3. The Contractor undertakes to provide the Contracting Authority, together with the first delivery of reagents, with safety data sheets current as of the delivery date for all supplied reagents for which the obligation to prepare a safety data sheet arises from the applicable provisions of law. 4. If a safety data sheet is updated during the term of the contract, the Contractor undertakes to provide the Contracting Authority with its current version immediately, no later than together with the first delivery of the reagent following the update. 5. Safety data sheets provided to the Contracting Authority must be prepared in Polish, in accordance with the applicable provisions of law. 6. Common Procurement Vocabulary (CPV): 33.69.65.00-0, 38.43.40.00-6 Foreign entity 1. If the contractor has its registered office or place of residence outside the borders of the Republic of Poland, instead of: 1) the information from the National Criminal Register referred to in point 10.1/1 of the SWZ (§ 2(1)(1) of the Regulation on subjective means of evidence) - it shall submit information from the relevant register, such as a court register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, within the scope referred to in point 10.1/1 of the SWZ (§ 2(1)(1) of the Regulation on subjective means of evidence); 2) the certificate referred to in point 10.1/3 of the SWZ (§ 2(1)(4) of the Regulation on subjective means of evidence), a certificate or another document confirming that the contractor is not in arrears with the payment of social security or health insurance contributions, as referred to in point 10.1/4 of the SWZ (§ 2(1)(5) of the Regulation on subjective means of evidence), or an extract or information from the National Court Register or from the Central Register and Information on Economic Activity, as referred to in point 10.1/5 of the SWZ (§ 2(1)(6) of the Regulation on subjective means of evidence) - it shall submit a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming respectively that: a) it has not breached its obligations relating to the payment of taxes, fees, or social security or health insurance contributions, b) its liquidation has not been opened, it has not been declared bankrupt, its assets are not managed by a liquidator or a court, it has not entered into an arrangement with creditors, its business activity is not suspended, nor is it in another situation of this kind resulting from a similar procedure provided for in the laws of the place where such proceedings were initiated. 2. The document referred to in point 10.2/1/1 of the SWZ should be issued no earlier than 6 months before its submission. The documents referred to in 10.2/1/2 of the SWZ should be issued no earlier than 3 months before their submission. 3. If, in the country in which the contractor has its registered office or place of residence, the documents referred to in point 10.2/1 are not issued, or if these documents do not relate to all the cases referred to in Article 108(1), points 1, 2, and 4, Article 109(1), point 1, point 2(a) and (b), and point 3 of the Act, they shall be replaced, as appropriate, in whole or in part, by a document containing, as appropriate, a declaration by the contractor, indicating the person or persons authorized to represent it, or a sworn declaration by the person to whom the document was to relate, or, if there are no provisions on sworn declarations in the country in which the contractor has its registered office or place of residence, a declaration made before a judicial or administrative authority, a notary, or a professional or economic self-government body competent with regard to the contractor’s registered office or place of residence. The provision of point 10.2/2 shall apply. Certification of contractors: 1. In the contract award procedure, instead of the relevant subjective means of evidence, the contractor may submit a certificate confirming the absence of grounds for exclusion from the contract award procedure referred to in Article 108(1), points 1-5, and paragraph 2 of the Pzp Act, as well as a certificate confirming the Contractor’s capacity to duly perform the contract, serving to demonstrate compliance with the conditions for participation in the procedure within the scope referred to in Article 112(2), point 1, 2, 3, or 4 of the Pzp Act (Chapter 10 of the SWZ). 2. Before awarding the contract, the Contracting Authority may require subjective means of evidence from the contractor that submitted the certificate referred to in paragraph 1 to confirm the absence of the ground for exclusion from the procedure referred to in Article 109(1), point 1 of the Pzp Act.
