Opportunity description

1. The subject matter of the contract is the supply of antibodies, reagents and consumables for automated histochemical, immunohistochemical (IHC) and “in situ hybridization” (ISH) staining in an open or closed system, together with the lease of equipment for the Clinical Department of Pathomorphology of the Fryderyk Chopin University Clinical Hospital in Rzeszów, ul. Rycerska 2. 2. A detailed description of the subject matter of the contract, the estimated quantity and the requirements are set out in: Price and tender forms (Attachments Nos. 1÷3 to the SWZ), List of required parameters of equipment and reagents for IHC/ISH immunohistochemical staining – 4 units (Attachment No. 4 to the SWZ), List of required parameters of equipment and reagents for performing histochemical staining (Attachment No. 5 to the SWZ), which constitute an integral part of the SWZ. 3. The requirements concerning the manner of contract performance, in particular the rights and obligations of the Parties, the rules for performance of the agreement, acceptance of the subject matter of the contract, provision of maintenance services, payment terms, liability of the Parties and the remaining conditions for performance of the contract, are specified in the Draft Contractual Provisions constituting Attachment No. 12 to the SWZ. These documents constitute an integral part of the Specification of Contract Terms. 4. The scope of the contract includes the supply of the subject matter of the contract in the quantities specified in the Price and Tender Forms, which constitute an integral part of the SWZ, for a period of 24 months. 5. The Contracting Authority does not permit the submission of variant tenders. 6. The Contracting Authority does not permit the submission of equivalent tenders. 7. The Contracting Authority is not dividing the contract into lots. Accordingly, the Contracting Authority does not permit the submission of partial tenders referred to in Article 7(15) of the Public Procurement Law. Reasons for not dividing the contract: The subject matter of the contract is the purchase of reagents for automated histochemical, immunohistochemical (IHC) and in situ hybridization (ISH) staining in an open or closed system, together with the lease of testing equipment for the Contracting Authority’s Clinical Department of Pathomorphology. The reagents offered should be compatible with the leased equipment offered. Dividing the contract into lots would result in technical difficulties and the need to coordinate the activities of different Contractors performing individual lots of the contract, which could seriously jeopardize the proper performance of the contract. 8. CONTRACT PERFORMANCE PERIOD: 1) Contract performance period – 24 months from the date of conclusion of the agreement. 2) The Contracting Authority permits the possibility of changing the term of the agreement if the entire subject matter of the agreement is not completed during the term of the agreement as a result of lower orders being placed – an amendment to the agreement requires an annex, provided that the Contracting Authority unilaterally notifies the Contractor of the proposed extension of the agreement before the expiry of the period for which it was concluded (does not apply to the lease) 1.
