Opportunity description
The subject matter of the contract is the lease of analyzers for blood culture, identification and antimicrobial susceptibility testing of microorganisms, Gram staining, detection of acid-fast bacilli, diagnostics using LAMP, ELISA, immunoblot and indirect fluorescence methods, together with the necessary tests and accessories for a period of 24 months (see – assortment and price form, i.e. Description of the Subject Matter of the Contract (OPZ) – constituting Appendix No. 2 to the SWZ) and in the Description of Technical Parameters – Appendix No. 3 to the SWZ from the award of the contract. 4. Entity-specific evidence required from the Contractor includes: 1) Information from the National Criminal Register concerning: a) Article 108(1)(1) and (2) of the Public Procurement Law, b) Article 108(1)(4) of the Public Procurement Law, concerning a judgment imposing a prohibition on applying for a public contract as a penal measure, issued no earlier than 6 months before its submission. 2) A declaration by the Contractor, within the scope of Article 108(1)(5) of the Public Procurement Law, that it does not belong to the same capital group, within the meaning of the Act of 12.07.2023 on Competition and Consumer Protection (Journal of Laws of 2025, item 1714), as another contractor that submitted a separate tender, partial tender or request to participate in the procedure, or a declaration of belonging to the same capital group together with documents or information confirming that the tender, partial tender or request to participate in the procedure was prepared independently of another Contractor belonging to the same capital group – Appendix No. 8 to the SWZ, 3) A declaration by the Contractor that the information contained in the declaration referred to in Article 125(1) of the Public Procurement Law remains current, with respect to the grounds for exclusion from the procedure specified by the Contracting Authority, referred to in: a) Article 108(1)(3) of the Public Procurement Law, b) Article 108(1)(4) of the Public Procurement Law, concerning a judgment imposing a prohibition on applying for a public contract as a preventive measure, c) Article 108(1)(5) of the Public Procurement Law, concerning the conclusion of an agreement with other Contractors intended to distort competition, d) Article 108(1)(6) of the Public Procurement Law. – Appendix No. 5 to the SWZ. 4) A declaration by the Contractor regarding the grounds for exclusion from the procedure referred to in Article 5k of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 111/1, 8.4.2022) and Article 7(1)(1–3) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and protecting national security (Journal of Laws of 2025, item 514). 5) An extract or information from the National Court Register or the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the Public Procurement Law, issued no earlier than 3 months before its submission, if separate regulations require entry in a register or records. 6) A list of supplies comparable to the supplies constituting the subject matter of the contract, completed and, in the case of recurring or continuous services, also being performed, during the last 3 years, or, if the period of business activity is shorter, during that period, specifying their value, subject matter, dates of performance and the entities for which the supplies were performed or are being performed, together with evidence specifying whether those supplies were or are being performed properly, whereby the evidence referred to consists of references or other documents prepared by the entity for which the supplies were performed or, in the case of recurring or continuous services, are being performed, and if the Contractor, for reasons beyond its control, is unable to obtain these documents – a declaration by the Contractor; in the case of recurring or continuous services still being performed, references or other documents confirming their proper performance should have been issued within the last 3 months – in accordance with the condition set out in Chapter VIII, point 2.4) – Appendix No. 9 to the SWZ, In order to confirm that the Contractor meets the conditions for participation in the procedure: For the list of supplies specified in Chapter VIII. CONDITIONS FOR PARTICIPATION IN THE PROCEDURE, paragraph 2, subpoint 3), the Contractor is required to attach to the tender a preliminary declaration in the form of a Single European Procurement Document (Part IV, Section α) – Appendix No. 4 to the SWZ, and the Contractor whose tender receives the highest evaluation shall also, at the request of the Contracting Authority, submit documents confirming these circumstances: The Contractor will meet the condition if it demonstrates that, during the last 3 years, or, if the period of business activity is shorter, during that period, it properly completed at least 3 supplies consisting of supplies comparable to the supplies constituting the subject matter of the contract, with a minimum value for the individual packages of: Package No. 1 A / 1 B 128 108,00 Package No. 2 A 73 031,00 Package No. 2 B 19 256,00 Package No. 3 135 957,00 Package No. 4 138 452,00 Package No. 5 79 857,00 Package No. 6 29 270,00 gross for each supply. A Contractor submitting a tender for several packages must demonstrate the completion and, in the case of continuous services, also the ongoing performance, of a minimum of 3 supplies with the required total value equal to the sum of the packages covered by the tender.
