The detailed scope of obligations relating to the performance of the subject matter of the contract is provided in the document entitled: “Draft contractual provisions”, constituting Appendix No. 7 to the SWZ. 1. The subject matter of the contract is successive deliveries of specialized biochemical and hematological reagents, control materials and consumables for the needs of UPWr units. 2 A detailed description of the subject matter of the contract is provided in the document entitled: “Product and Price Sheet”, constituting Appendix No. 8 to the SWZ. 3. The detailed scope of obligations relating to the performance of the subject matter of the contract is provided in the document entitled: “Draft contractual provisions”, constituting Appendix No. 7 to the SWZ. 4. General provisions concerning the subject matter of the contract: 4.1. Delivery of the subject matter of the contract will be carried out successively, according to the current needs of the Contracting Authority, in parts, on the basis of partial orders specifying the quantity and material scope of the ordered subject matter of the contract; 4.2. The tender must be unambiguous and comprehensive, i.e. cover the entire assortment comprising the subject matter of the contract. The Contractor is obliged to submit a tender whose content will allow the Contracting Authority to verify the tender in terms of its compliance with the content of the SWZ. The content of the Contractor’s tender must correspond to the content of the contract specifications. Thus, the Contractor is obliged to complete the Product and Price Sheet – constituting Appendix No. 8 to the SWZ – by providing the unit prices necessary for settlement of the contract, as well as to calculate the tender price in the Tender Form. 4.3. The subject matter of the contract includes: 1) the purchase by the Contracting Authority of basic reagents and control materials and consumables, carried out through basic orders, specified in the “Product and Price Sheet” (constituting Appendix No. 2 to the Contract), as well as optional reagents together with control materials and consumables, carried out through optional orders. 2) delivery of basic and optional reagents together with control materials and consumables to the location indicated by the Contracting Authority, 3) provision of the complete documentation referred to in § 6 of the Contract for the delivered subject matter of the Contract, 4) ensuring and providing warranty service for the subject matter of the Contract in accordance with §7 of the Contract. 4.4. The Contractor is obliged, at its own expense and risk, to make safety data sheets, including safety data sheets for hazardous substances, available to the Contracting Authority no later than on the date of their first delivery under the concluded contract, except in cases where possession of a safety data sheet for a particular substance or preparation is not required. Guided by the principles of sustainable development, including care to ensure that performance of the contract has a positive impact that affects the environment as little as possible – the Contracting Authority permits and prefers the provision of safety data sheets in electronic form – by email or by providing a link to a website from which the Contracting Authority will be able to download the relevant document independently and decide whether there is a need/necessity to print it. 4.5. The Contracting Authority reserves the right to withdraw from part of the basic order up to a maximum of 25% of the gross value of the basic order, and thus the Contracting Authority undertakes to purchase the subject matter of the basic order in an amount of at least 75% of the gross tender value. 4.6. In order to ensure the comparability of tenders, the Contracting Authority requires that the reagents offered be in package sizes consistent with those specified by the Contracting Authority.
