The detailed scope is set out in the annexes to the SWZ and in the description of the subject matter of the contract constituting an annex to No. 5 of the SWZ, under the terms specified in the draft contract constituting Annex No. 4 to the SWZ. The Contracting Authority permits the submission of equivalent tenders under the following rules: A Contractor relying on equivalent solutions is required to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach a list of equivalent solutions to the tender. a) The Contracting Authority stipulates that wherever the documentation constituting the description of the subject matter of the contract indicates trademarks, patents or origin, sources or specific processes that characterize products or services supplied by a specific contractor, the Contracting Authority permits methods, materials, equipment, systems, technologies, etc. equivalent to those presented in the description of the subject matter of the contract. It is therefore permissible to propose in the tender any equivalent market substitutes with properties no worse than those indicated by the Contracting Authority. The parameters of the indicated standard define the minimum technical, operational, performance, quality and functional conditions to be met by the subject matter of the contract. The indicated trademarks, patents, brands or names of the manufacturer, sources or specific processes indicating origin define only the class of product, methods, materials, equipment, systems, technologies, etc. b) The tender may propose methods, materials, equipment, systems, technologies, etc. of other brands and manufacturers, but with technical and quality parameters, performance properties and functional properties corresponding to the methods, materials, equipment, systems, technologies, etc. described in the SWZ. c) When describing the subject matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority permits the use of solutions equivalent to those described, and the words "or equivalent" shall be added to such a reference. d) Where the documentation constituting the description of the subject matter of the contract describes it by means of specific standards, European technical assessments, approvals or technical specifications and technical reference systems, as well as by indicating trademarks or origin, the Contracting Authority states that such wording is merely exemplary and serves as an indication to the Contractor of the characteristics that the materials used to perform the subject matter of the contract should possess. The Contracting Authority permits performance of the contract using equivalent solutions. By providing proprietary product names, the Contracting Authority specifies the minimum technical parameters, performance and quality characteristics (including: dimensions, composition, material used, color, shade, intended use of the equipment, aesthetics, etc.) with which equivalent materials should comply in order to meet the stated requirements." e) Whenever equivalent solutions are permitted in the description of the subject matter of the contract, this means: a technically similar solution that is no worse in terms of the functional parameters described by the Contracting Authority. f) The Contractor submitting an equivalent tender bears the burden of proving the equivalence of the products offered.
