Opportunity description
1. The subject matter of the Contract is the delivery of a shunting locomotive. 2. The scope of the contract includes the delivery of a two-axle diesel-powered shunting locomotive (hereinafter: the locomotive) with a maximum speed of up to 40 km/h, intended for light shunting work throughout the metro infrastructure and for transporting metro railway vehicles on routes with a track gauge of 1435 mm. 3. The locomotive must be adapted for operation with metro vehicles used by the Contracting Authority: Varsovia, Inspiro, Metropolis 98B, series 81 vehicles, as well as 208 Kg/M barrier wagons. Furthermore, it must be capable of operating in double traction (multiple-unit control) with an LM-400 locomotive and a type 794 locomotive. The Contracting Authority specified the technical requirements for the locomotive in the Technical Specification with appendices (hereinafter: “ST”), constituting the description of the Subject Matter of the Contract and forming an integral part of this SWZ, including Appendix No. 1 to the ST, i.e. the document entitled “Parameters and technical requirements of the locomotive”. 4. The Subject Matter of the Contract must be performed in three stages with the scopes indicated in the ST. As part of the performance of the Subject Matter of the Contract, the Contractor shall prepare full and complete technical documentation containing all technical descriptions of the assemblies and subassemblies of the delivered locomotive, as well as operating documentation containing a list of the catalogue numbers of parts, assemblies and subassemblies. The documentation should be prepared in Polish and take into account the technical requirements specified in Appendix No. 1 to the ST. Furthermore, on a date agreed with the Contracting Authority preceding the date on which the locomotive is approved for operation, the Contractor shall, at its own expense, conduct training in the operation and maintenance of the locomotive. The training conditions are specified in point 3.11 of the ST. 5. If the Subject Matter of the Contract is performed using solutions equivalent to the standards indicated by the Contracting Authority in the ST and its appendices, the Contractor is obliged to prove that the proposed solutions satisfy the requirements specified in the description of the Subject Matter of the Contract to an equivalent degree. For this purpose, the Contractor is obliged to submit together with the tender: 1) a declaration (on the Contractor’s own form), in which the Contractor is obliged to: declare that it will perform the Subject Matter of the Contract using solutions equivalent to the standards indicated by the Contracting Authority in the ST, indicate with respect to which standards indicated by the Contracting Authority in the ST and its appendices it will perform the Subject Matter of the Contract using solutions equivalent to the aforementioned standards and indicate the proposed solutions equivalent to the aforementioned standards, 2) the subject-matter evidence referred to in point 12 of the SWZ. If the Contractor does not submit together with the tender the aforementioned declaration concerning performance of the Subject Matter of the Contract using solutions equivalent to the standards indicated by the Contracting Authority in the ST, the Contracting Authority shall consider that the Contractor is offering to perform the Subject Matter of the Contract in accordance with the standards indicated in the ST. 6. The Subject Matter of the Contract shall be performed in accordance with the procurement procedure documentation, i.e.: this SWZ and its appendices, in particular the ST with appendices (Appendix No. 1 to the SWZ) and the Model Contract (Appendix No. 2 to the SWZ).
