1. The subject of the contract is the conclusion of a Framework Agreement for the provision of comprehensive catering services during events organized by the Contracting Authority, consisting of one-off or periodically recurring (cyclical) services, for a period of 36 months from the date of conclusion of the Framework Agreement or until the total amount allocated for the performance of these services, amounting to PLN 2,000,000.00 gross (two million zlotys), has been exhausted. The above-mentioned amount takes into account the anticipated increase in prices during the term of the Framework Agreement and will not be subject to indexation, subject to the permissible indexation of the unit prices of menu items and additional services, in accordance with the rules set out in § 10 of the Framework Agreement. 2. Catering services shall be understood as services encompassing the preparation of meals (from raw ingredients to finished dishes) and their serving at the venue of a specific event, i.e. at facilities located in Warsaw, in particular facilities of the Contracting Authority or the WUM University Clinical Center, located on the Banacha campus, between the following streets: Banacha, Żwirki i Wigury, Księcia Trojdena and Pawińskiego. 3. Pursuant to Article 95 of the Act, the Contracting Authority requires that activities involving the preparation of meals constituting the subject of the catering services be performed by persons employed by the Contractor or a Contractor jointly applying for the award of the contract under an employment contract within the meaning of the Act of 26 June 1974, the Labour Code (consolidated text: Journal of Laws of 2025, item 277, as amended). 4. In each award procedure under the framework agreement, the Contractor will be required to submit a declaration that it holds a valid certificate of entry in the register of establishments subject to official inspection by the authorities of the State Sanitary Inspection or an appropriate Decision of the State District Sanitary Inspector confirming that the conditions of the Contractor's infrastructure meet the sanitary and hygiene requirements concerning food production and food trade. 5. The Contracting Authority will conclude the Framework Agreement, the Draft of which constitutes Appendix No. 6 to the SWZ, with the three Contractors whose tenders are the most advantageous in light of the tender evaluation criterion (price 100%), unless fewer Contractors submit tenders that are not subject to rejection. 6. When proceeding to award a specific contract covered by the Framework Agreement, the Contracting Authority, in the Invitation to submit a tender in the award procedure under the framework agreement, prepared according to the template constituting Appendix No. 3 to the Framework Agreement, will specify in particular: the place and date of provision of the service/services provided cyclically, the number of event participants, the place and deadline for submission of tenders and, in the Tender Form in the award procedure under the framework agreement and the Price Form in the award procedure under the framework agreement, constituting Appendices No. 1 and No. 2 to the Invitation, the required menu and additional requirements—the number of banquet tables and chairs, cocktail tables, the additional number of waiters, requirements concerning table arrangements (if required), as well as any information concerning a waiver of the requirement to provide waiter service, tableware, catering linen or other requirements specified in § 4 of the Draft Framework Agreement. 7. Individual contracts referred to in paragraphs 1 and 2, provided on a one-off or cyclical basis, will be performed under Specific Contracts, the Drafts of which constitute Appendix No. 4a and Appendix No. 4b, respectively, to the Draft Framework Agreement, by the Contractor that, in response to the Invitation to submit a tender in the award procedure under the framework agreement, submits the most advantageous tender in light of the tender evaluation criterion (price 100%), subject to paragraph 8. 8. A tender submitted in the award procedure under the framework agreement for individual services may not be less advantageous than the tender submitted in the procedure conducted for the purpose of concluding the Framework Agreement, under penalty of rejection of the tender, subject to paragraph 9. 9. In the case of catering services for a group of participants equal to or smaller than 20 persons, Contractors will be entitled to apply the maximum unit prices of menu items and additional services referred to in paragraph 6, increased by 10% compared with the prices offered in the procedure conducted for the purpose of concluding the Framework Agreement, provided that the Framework Agreement applies to the provision of catering services for a group of participants in a specific event (of a one-off nature) with a service value of not less than PLN 1,000.00 gross, determined on the basis of the maximum prices of the most advantageous of the tenders submitted by the Contractors in the procedure conducted for the purpose of concluding the Framework Agreement. 10. The detailed rules for awarding individual contracts during the term of the Framework Agreement and the procedures for selecting the most advantageous tenders (three, unless fewer Contractors submit tenders that are not subject to rejection) are specified in the Draft Framework Agreement constituting Appendix No. 6 to the SWZ, the Tender Form constituting Appendix No. 1 to the SWZ, and the Price Form constituting Appendix No. 2 to the SWZ. 11. During the term of the Framework Agreement (36 months), the Contracting Authority anticipates organizing approximately 170 events with the following numbers of participants, provided that some events are cyclical: - from 15 to 70 persons will participate in 70 events; - from 70 to 150 persons will participate in 40 events; - from 150 to 300 persons will participate in 40 events; - 300 or more persons will participate in 20 events. 12. The anticipated scope of the contract (during the term of the Framework Agreement), specified as to the type and number of menus and additional requirements, is contained in the Price Form constituting Appendix No. 2 to the SWZ, which serves to select the Contractors (three, unless fewer Contractors submit tenders that are not subject to rejection) with whom the Framework Agreement will be concluded. 13. It is recommended that the above Price Form be completed electronically, in xls. format, with a formula that automatically multiplies the items in the rows and column of the table, in order to eliminate possible calculation errors.
