Opportunity description

1. The subject of the contract is “Cybersecure PGKiM in Sandomierz – raising the security level of IT/OT systems under the Cybersecure Waterworks project”, within the scope of which the delivery of factory-new computer equipment manufactured no earlier than January 2025, delivered in its original packaging (the packaging must be intact and have the security seal applied by the manufacturer), as well as its assembly, installation and configuration, the preparation of the documentation required in the Description of the Subject of the Contract (OPZ), the implementation of cybersecurity systems, the delivery of the licences and systems referred to in the OPZ, the provision of training in the operation of the implemented devices and systems, and the conduct of audits [hereinafter: “one-off service”] will be carried out. Furthermore, the Contracting Authority requires the Contractor, for a period of 36 months following final acceptance, under the terms set out in the agreement constituting Appendix No. 10 to the Specification of Contract Terms (SWZ), to provide the Contracting Authority, as part of maintaining the sustainability of the project, with continuous services consisting, inter alia, of technical support, technical assistance, servicing, and ensuring the validity and continuity of updates and licences [hereinafter: “continuous service”]. The software, licences and implementation of cybersecurity systems, understood as installation, testing and configuration, must be new, unused, not previously activated on another device, and delivered in the latest stable version. 2. A detailed description of the subject of the contract is contained in Appendix No. 7 to this Specification of Contract Terms. 1. A detailed description of the subject of the contract is contained in Appendix No. 7 to this Specification of Contract Terms. 3. If the subject of the contract has been defined by reference to trademarks, patents or origin, the Contracting Authority permits the submission of tenders using equivalent solutions in this respect. Where the description of the subject of the contract indicates the origin of the devices covered by the contract (e.g. brand, trademark, manufacturer, supplier), the Contracting Authority permits devices with equivalent parameters—identical to or better than those contained in the description—to be offered. Equivalence shall be understood to mean that they will guarantee performance of the contract in accordance with the description of the subject of the contract and ensure technical and quality parameters and warranty requirements no worse than those assumed in the above-mentioned description. The proper names given in the descriptions of the subject of the contract serve only to specify the Contracting Authority’s quality, technical and technological expectations. The description of the equivalence criteria follows from the required parameters (as applicable to the individual elements of the delivery), according to the Description of the Subject of the Contract constituting Appendix No. 7 to the SWZ. 4. A Contractor relying on solutions equivalent to those described by the Contracting Authority is required to demonstrate in the tender that the supplies and services it offers meet the requirements specified by the Contracting Authority. The burden of proving equivalence rests with the Contractor. In the tender form, that Contractor shall indicate whether it is offering an equivalent solution, to what extent, and whether that solution meets the equivalence conditions stipulated by the Contracting Authority. 5. The Contracting Authority does not permit the submission of variant tenders. 6. The Contracting Authority does not envisage conducting an electronic auction. 7. The subject of this contract is not the conclusion of a framework agreement. 8. The Contracting Authority is not dividing the contract into lots due to the need to ensure full synchronisation, integrity and compatibility of the systems and devices being implemented and therefore does not permit the submission of tenders for individual lots. A division involving splitting the delivery volume would risk excessive contract performance costs due to the loss of economies-of-scale benefits. Economies of scale mean a reduction in the share of fixed costs in the unit costs of delivery as a result of increasing the scale of operations; in the case of a contract for the delivery, implementation, configuration and commissioning of ICT infrastructure and cybersecurity systems, together with the provision of accompanying services for the Contracting Authority. Thus, there is a close relationship between the size of the contract and the method of calculating the price for the delivery. Furthermore, dividing the contract into lots would disperse responsibility among different Contractors. 9. The Contracting Authority requires a warranty to be provided for the delivered equipment and the work performed as set out in the OPZ (Appendix No. 7 to the SWZ) and the draft agreement (Appendix No. 10 to the SWZ), in accordance with the conditions provided for in the OPZ and the proposed contractual provisions. The Contracting Authority additionally requires the Contractor, for a period of 36 months following final acceptance, to provide the Contracting Authority with continuous services—maintenance services for the delivered software and systems, including, inter alia, technical support, technical assistance and servicing, and to ensure the continuity and validity of licences and updates. 10. Tenders that do not cover the full scope of the subject of the contract will be rejected. 11. The Contracting Authority requires that the performance offered, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service delivery environment or accompanying solutions, shall not include: 11.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, stating their adverse impact on the fundamental interest of state security; 11.2. an ICT product whose type has been specified in the decision recognising a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Article 226(1)(17) or (19) of the Public Procurement Law. Procedure: open.
