Opportunity description
The subject of the contract is “Cybersecure PGKiM in Sandomierz – raising the security level of IT/OT systems under the Cybersecure Water Utilities project”, within the scope of which the supply of brand-new computer equipment manufactured no earlier than January 2025, delivered in its original packaging (the packaging must be intact and have the security protection applied by the manufacturer), and its assembly, installation and configuration will be carried out, as well as the preparation of the documentation required in the OPZ, implementation of cybersecurity systems, supply of the licences and systems referred to in the OPZ, conducting training in the operation of the implemented devices and systems, and conducting audits [hereinafter: “one-off service”]. In addition, the Contracting Authority requires the Contractor, for a period of 36 months after final acceptance, under the terms specified in the agreement constituting Annex No. 10 to the SWZ, to provide the Contracting Authority, as part of maintaining the sustainability of the project, with continuous services consisting, inter alia, of technical support, technical assistance, provision of maintenance services, ensuring that updates and licences remain current and continuously updated [hereinafter: “continuous service”]. The software, licences and implementation of cybersecurity systems, understood as installation, testing and configuration, must be new, unused, not previously activated on another device, and supplied in the latest stable version. 1. The subject of the contract is “Cybersecure PGKiM in Sandomierz – raising the security level of IT/OT systems under the Cybersecure Water Utilities project”, within the scope of which the supply of brand-new computer equipment manufactured no earlier than January 2025, delivered in its original packaging (the packaging must be intact and have the security protection applied by the manufacturer), and its assembly, installation and configuration will be carried out, as well as the preparation of the documentation required in the OPZ, implementation of cybersecurity systems, supply of the licences and systems referred to in the OPZ, conducting training in the operation of the implemented devices and systems, and conducting audits [hereinafter: “one-off service”]. In addition, the Contracting Authority requires the Contractor, for a period of 36 months after final acceptance, under the terms specified in the agreement constituting Annex No. 10 to the SWZ, to provide the Contracting Authority, as part of maintaining the sustainability of the project, with continuous services consisting, inter alia, of technical support, technical assistance, provision of maintenance services, ensuring that updates and licences remain current and continuously updated [hereinafter: “continuous service”]. The software, licences and implementation of cybersecurity systems, understood as installation, testing and configuration, must be new, unused, not previously activated on another device, and supplied in the latest stable version. 2. A detailed description of the subject of the contract is contained in Annex No. 7 to these Specifications of Contract Terms. 3. If the subject of the contract has been defined by reference to trademarks, patents or origin, the Contracting Authority permits the submission of tenders using equivalent solutions in this respect. Wherever the description of the subject of the contract indicates the origin of the devices covered by the contract (e.g. brand, trademark, manufacturer, supplier), the Contracting Authority permits devices with equivalent parameters—identical to or better than those included in the description—to be offered. Equivalence shall be understood to mean that they will guarantee performance of the contract in accordance with the description of the subject of the contract and ensure technical and quality parameters and warranty requirements no worse than those assumed in the above-mentioned description. The proprietary names provided in the descriptions of the subject of the contract are intended solely to specify the Contracting Authority’s quality, technical and technological expectations. The description of the equivalence criteria follows from the required parameters (as appropriate for the individual elements of the supply), according to the Description of the subject of the contract constituting Annex No. 7 to the SWZ. 4. A Contractor that invokes solutions equivalent to those described by the Contracting Authority is obliged to demonstrate in the tender that the supplies and services it offers meet the requirements specified by the Contracting Authority. The burden of proving equivalence rests with the Contractor. In the tender form, that Contractor shall indicate whether it is offering an equivalent solution, to what extent, and whether that solution meets the equivalence conditions set by the Contracting Authority. 5. The Contracting Authority does not permit the submission of variant tenders. 6. The Contracting Authority does not envisage conducting an electronic auction. 7. The subject of this contract is not the conclusion of a framework agreement. 8. The Contracting Authority is not dividing the contract into lots due to the need to ensure full synchronisation, integrity and compatibility of the systems and devices being implemented and therefore does not permit the submission of tenders for individual lots. A division involving splitting the volume of the supply would risk excessive contract performance costs due to the loss of economies of scale. Economies of scale mean reducing the share of fixed costs in the unit costs of supply as a result of increasing the scale of operations; in the case of a contract for the supply, implementation, configuration and commissioning of ICT infrastructure and cybersecurity systems, together with the provision of accompanying services to the Contracting Authority. Thus, there is a close relationship between the size of the contract and the method of calculating the price for the supply. Furthermore, dividing the contract into lots would result in responsibility being dispersed among different Contractors. 9. The Contracting Authority requires a warranty to be provided for the supplied equipment and the completed work included in the OPZ (Annex No. 7 to the SWZ) and the draft agreement (Annex No. 10 to the SWZ), in accordance with the conditions provided for in the OPZ and the draft contractual provisions. The Contracting Authority additionally requires the Contractor, for a period of 36 months after final acceptance, to provide continuous services to the Contracting Authority—maintenance services for the supplied software and systems, including, inter alia, technical support services, technical assistance, maintenance services, and ensuring the continuity and currency of licences and updates. 10. Tenders that do not include the full scope of the subject of the contract will be rejected. 11. The Contracting Authority requires that the offered provision, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service delivery environment or accompanying solutions, shall not include: 11.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have an adverse impact on the fundamental security interest of the state; 11.2. an ICT product whose type has been specified in a decision recognising a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Article 226(1)(17) or (19) of the Pzp Act. Procedure: open.
