Opportunity description

1. The subject matter of the contract is the delivery and installation of a redundant disk array, including implementation work. 2. A detailed description of the subject matter of the contract is contained in the model Agreement together with its appendices, constituting Appendix No. 10 to the SWZ. 3. The Contracting Authority does not require the contract to be performed by sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94(1) of the Act. 4. Due to the nature of this contract (supply), the Contracting Authority does not require persons to be employed (by the Contractor or subcontractors) under an employment relationship. 5. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(8) of the Act. 6. The Contracting Authority does not permit the submission of variant tenders. 7. The Contracting Authority does not provide for an electronic auction. 8. Before commencing the procedure, the Contracting Authority did not conduct preliminary market consultations. 9. In this procedure, the Contracting Authority does not divide the contract into lots or permit the submission of tenders for individual lots, for the following reason: The Contracting Authority refrained from dividing the contract into lots because the subject matter of the contract includes the delivery and implementation of a redundant disk array, together with a comprehensive reconstruction of the storage environment of the Kraków City Office. The individual elements of the contract, including delivery of the device, reconfiguration of the SAN network, configuration of replication mechanisms, data migration, restoration of high-availability mechanisms, and performance of acceptance tests, constitute a technologically and functionally interconnected process, the proper implementation of which requires full compatibility to be maintained and a single contractor to be responsible for the entire implementation. Dividing the contract into lots could lead to problems related to coordinating work carried out by different contractors, dilution of responsibility for the proper functioning of the environment, extension of the implementation process, and an increased risk of downtime or loss of continuity in the operation of the Contracting Authority’s IT systems. The absence of a division of the contract into lots is therefore justified by technical and organizational considerations and by the need to ensure the safe and consistent implementation of the entire storage environment migration process. The absence of a division into lots does not restrict access to the contract for small and medium-sized enterprises, and Contractors operating in the industry covered by the subject matter of the contract can supply all of its elements. 10. Within the limits laid down in Article 462 et seq. of the Act, the Contracting Authority permits the Contractor to perform the subject matter of the contract using subcontractors. A Contractor intending to entrust the performance of part of the contract to subcontractors shall indicate in its tender the parts of the contract it intends to entrust to subcontractors and provide the names of any subcontractors, if already known. 11. In this procedure, the Contracting Authority does not require Contractors to submit means of evidence relating to the subject matter of the contract. Procedure: open. Estimated value: 5,585,000 PLN.
