The subject matter of the contract is the supply of surgical clips and surgical staplers – (see – assortment and price form, i.e. Description of the Subject Matter of the Contract (OPZ) - Annex No. 2) over a period of 24 months from the award of the contract. 4. The entity-related means of evidence required from the Contractor include: 1) Information from the National Criminal Register regarding: a) Article 108(1)(1) and (2) of the Pzp Act, b) Article 108(1)(4) of the Pzp Act, concerning a ruling prohibiting participation in public procurement procedures as a penal measure, drawn up no earlier than 6 months before its submission. 2) A statement by the Contractor, within the scope of Article 108(1)(5) of the Pzp Act, confirming that it does not belong to the same capital group, within the meaning of the Act of 16.02.2007 on competition and consumer protection, as another contractor that submitted a separate tender, partial tender or request to participate in the procedure, or a statement confirming membership of the same capital group together with documents or information confirming that the tender, partial tender or request to participate in the procedure was prepared independently of another Contractor belonging to the same capital group - Annex No. 7 to the SWZ, 3) A statement by the Contractor confirming that the information contained in the statement referred to in Article 125(1) of the Pzp Act remains current, with regard to the grounds for exclusion from the procedure specified by the Contracting Authority, referred to in: a) Article 108(1)(3) of the Pzp Act, b) Article 108(1)(4) of the Pzp Act, concerning a ruling prohibiting participation in public procurement procedures as a preventive measure, c) Article 108(1)(5) of the Pzp Act, concerning the conclusion of an agreement with other Contractors aimed at distorting competition, d) Article 108(1)(6) of the Pzp Act, Annex No. 4 to the SWZ. 4) A statement by the Contractor regarding the grounds for exclusion from the procedure referred to in Article 5k of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No. 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine. - Annex No. 5 to the SWZ - Annex No. 6 to the SWZ (if applicable). 5) An extract or information from the National Court Register or from the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the Pzp Act, drawn up no earlier than 3 months before its submission, if separate regulations require entry in a register or records, 6) A list of supplies comparable to the supplies constituting the subject matter of the contract, completed and, in the case of recurring or continuous services, also being performed, during the last 3 years, or, if the period of conducting business activity is shorter, during that period, together with their value, subject matter, dates of performance and the entities for which the supplies were completed or are being performed, and with evidence specifying whether those supplies were completed or are being performed properly, whereby the evidence referred to consists of references or other documents drawn up by the entity for which the supplies were completed or, in the case of recurring or continuous services, are being performed, and if the Contractor, for reasons beyond its control, is unable to obtain those documents – a statement by the Contractor; in the case of recurring or continuous services that are still being performed, references or other documents confirming their proper performance should have been issued within the last 3 months – in accordance with the condition set out in Chapter VIII, point 2.4) - Annex No. 8 to the SWZ, The Contractor is required to attach to the tender a preliminary statement in the form of a single document (Part IV, Section α) – Annex No. 3 to the SWZ, and the Contractor whose tender receives the highest evaluation must also, at the request of the Contracting Authority, provide documents confirming these circumstances: − The Contractor will satisfy the condition if it demonstrates that, during the last 3 years, or, if the period of conducting business activity is shorter, during that period, it properly completed at least 3 supplies consisting of supplies comparable to the supplies constituting the subject matter of the contract, with a minimum value for the individual tasks of: Task No. 1 PLN 35 867,00 Task No. 2 PLN 35 672,00 Task No. 3 PLN 22 042,00 Task No. 4 PLN 95 937,00 Task No. 5 PLN 51 516,00 Task No. 6 PLN 128 304,00 Task No. 7 PLN 454 767,00 Task No. 8 PLN 158 670,00 Task No. 9 PLN 13 122,00 gross for each supply. A Contractor submitting a tender for several tasks must demonstrate completed supplies and, in the case of continuous services, also supplies being performed, consisting of a minimum of 3 supplies with the required total value equal to the sum of the tasks covered by the tender. The subject matter of the contract is the supply of surgical clips and surgical staplers – (see – assortment and price form, i.e. Description of the Subject Matter of the Contract (OPZ) - Annex No. 2) over a period of 24 months from the award of the contract.
