Opportunity description
1. The subject matter of the contract is: Supply of medical apparatus and equipment for the implementation of the project entitled “Investment in specialist outpatient care and the development of one-day care at SPZOZ MSWiA in Poznań” No. FENX.06.01-IP.03-0017/25, under FEnIKS – procedure I – Ophthalmic laser, consisting in the delivery and installation of the assortment specified in Annex No. [ ] to this contract. 2. The Contractor declares that the subject matter of the contract strictly complies with the requirements specified in Annex No. 2 to the SWZ (description of the subject matter of the contract). 3. The subject matter of the contract shall be ready for operation without any additional purchases or investments and shall be delivered at the Contractor’s expense and risk, using the Contractor’s transport, together with documentation in Polish. The year of delivery shall also be the year of manufacture of the relevant equipment, apparatus, and device. In justified cases arising from the investment process, with the Contracting Authority’s consent, the delivery of devices manufactured in the year preceding the year of delivery shall be permitted. 4. The Contractor shall deliver the subject matter of the contract to the Contracting Authority’s registered office using its own transport, at its own expense and risk, together with documentation in Polish, operating instructions, warranty terms, and a warranty card. 5. The Contractor shall deliver the subject matter of the contract on a working day, between 7:00 and 14:00, within 30 calendar days from the date of signing the contract. The Contractor shall notify the Contracting Authority of the planned delivery date at least 2 days in advance. 6. The Contractor shall conduct training for the Contracting Authority’s employees at the Contracting Authority’s registered office concerning the routine operation, maintenance, and use of the subject matter of the contract, on the first date as for the delivery and on subsequent dates agreed with the Contracting Authority. 7. The Contractor declares that the implementation of the investment task complies with the DNSH principle (“Do No Significant Harm”), referred to in Article 17 of Regulation (EU) 2020/852, applicable under the European Funds for Infrastructure, Climate, Environment 2021-2027 programme (FEnIKS). The implementation of the undertaking and the purchased devices and materials shall comply with all applicable environmental, climate, and energy standards. The project shall be implemented in a manner ensuring no adverse impact on environmental objectives, including climate change mitigation, adaptation to climate change, the sustainable use and protection of water and marine resources, the circular economy, pollution prevention and control, and the protection and restoration of biodiversity and ecosystems. The Contractor undertakes to manage waste generated during the implementation of the Investment at its own expense and in accordance with applicable laws. 9. The Contracting Authority imposes no restrictions concerning the origin of the Contractor or the subject matter of the contract in terms of market access and participation in this procedure. Ophthalmic laser compliant with the minimum parameters contained in Annex No. 2 to the SWZ. The Contracting Authority requires the delivery of brand-new devices and medical devices under the contract. Used, reconditioned, or demonstration devices and medical devices may not be offered. The devices and medical devices must be free from all physical (design) and legal defects. The apparatus offered must have the required attestations and certificates, as well as the marking stipulated by the provisions of the Act on Medical Devices, confirming the required authorization for use and marketing in Poland, i.e. a CE certificate and a declaration of conformity in accordance with the Regulation of the Minister of Health on essential requirements and conformity assessment procedures for medical devices, or equivalent documents resulting from their type and intended purpose. The offered subject matter of the contract must be complete and ready for use without additional purchases. Warranty: 60 months from the date of final acceptance by protocol without reservations. After the end of the warranty period, the Contractor shall provide the Contracting Authority with the required service documentation together with service codes (if applicable), enabling periodic technical inspection to be performed in accordance with the manufacturer’s recommendations. All servicing activities must be performed by an entity authorized by the manufacturer or the authorized representative to perform such activities, in accordance with Article 90 of the Act on Medical Devices. In connection with the above, upon delivery the Contractor shall attach a list of entities authorized by the manufacturer or the authorized representative to perform servicing activities. The description of the devices offered should leave no doubt for the Contracting Authority. The description should demonstrate that the offered subject matter of the contract has the same parameters as those required by the Contracting Authority or better parameters, by precisely specifying the offered parameters according to the points listed by the Contracting Authority in the schedule of required minimum technical and functional parameters.
