I. Subject matter of the contract: 1. The subject matter of the contract is the supply of medical equipment for the needs of the Zofia Tarnowska née Zamoyska Provincial Hospital in Tarnobrzeg, divided into 17 packages. II. Description of the subject matter of the contract: 1. CPV code according to the Common Procurement Vocabulary: 33100000 – 1 Medical devices 2. The Contractor is required to complete all items in Appendix No. 2 to the SWZ. 4. The subject matter of the contract includes: 1) Purchase of medical equipment, including: Package 1 – VNG set + irrigator – 1 set Package 2 – ENT unit with equipment – 1 pc Package 3 – High-speed ENT drill – 1 pc Package 4 – Cryostat – 1 pc Package 5 – Immunohistochemical staining apparatus – 1 set Package 6 – Immunohistochemical staining apparatus – 1 set Package 7 – EMG apparatus – 1 pc Package 8 – Blood pressure recorder – 3 pcs Package 9 – Gynecological chairs – 3 pcs Package 10 – Laboratory centrifuge with equipment – 1 pc Package 11 – KKP storage system – 1 pc Package 12 – Breast biopsy system – 1 pc Package 13 – Cryolesion apparatus – 1 pc Package 14 – X-ray apparatus with C-arm – 1 set Package 15 – Docking station for pumps – 4 pcs Package 16 – Spirometer with software – 1 set 2) Delivery of the above-mentioned equipment; 3) Assembly/installation, commissioning, testing and inspection of the above-mentioned equipment; 4) Training of the designated employees of the Contracting Authority in the operation of the above-mentioned equipment1; 5) Warranty servicing of the above-mentioned equipment, under the terms specified in § 81; 6) Provision of the warranty card for the above-mentioned equipment2; 7) Provision of the technical passport for the above-mentioned equipment1; 8) Provision of the equipment operating instructions in paper form in Polish, in electronic form in Polish, and technical (service) documentation. 5. The medical devices constituting the subject matter of this contract must comply with the requirements of the current legal framework, in particular those introduced by the Act of 7 April 2022 on medical devices (Journal of Laws of 2024, item 1620, as amended). 6. Equivalent solutions and equivalence assessment criteria: 1) The Contracting Authority shall consider a solution equivalent to the specified solution if it has the same intended use and technical, quality and functional characteristics corresponding to, or better than, the technical, quality and functional characteristics indicated in the description of the subject matter of the contract, and is designated by a different trademark, patent or origin. 2) An equivalent solution must enable the objective envisaged by the Contracting Authority to be achieved through performance and functional parameters affecting operational effectiveness that are the same as or better than the indicated minimum requirements. 3) The use of names of solutions, materials and devices in the description of the subject matter of the contract serves to establish the minimum standard of performance and to define the properties and technical requirements assumed in the technical documentation for the designed solutions. 4) The Contractor is required to demonstrate that the equivalent solutions offered will meet the assumed minimum requirements. 5) The absence of the term “minimum” means a requirement at the minimum level, and the Contractor may offer a solution with better parameters. 6) In order to maintain the principles of technological neutrality and competitiveness, solutions equivalent to those specified are permitted, whereby an equivalent solution is understood as a solution that, in terms of technology, performance and functionality, does not differ from or is better than the technology, functionality and performance detailed in the specified solution. 7) Characteristics of the solution that are specific exclusively to the specified solution, such as proprietary patents, proprietary technological solutions, proprietary protocols, etc., shall not be compared, but only those that constitute the essence of the entirety of the envisaged technological solutions and have a counterpart in the equivalent solution. Accordingly, the Contractor may propose solutions that implement the same functionalities specified by the Contracting Authority in a manner different from that stated. 8) A very similar utility value is understood to mean a similar value, allowing minor differences that do not affect in any way the system as a whole, its behavior, or the implementation of similar functionalities under the given conditions for which these solutions are intended. An equivalent solution must include documentation confirming that it meets the Contracting Authority’s functional requirements, including the results of comparisons, tests or capabilities offered by that solution in relation to the specified solution. 9) Additionally, wherever the origin (brand, trademark, manufacturer, supplier, etc.) of materials or standards, approvals, specifications and systems referred to in the Public Procurement Law has been indicated, the Contracting Authority permits the offering of equivalent equipment or solutions, provided that they ensure technical parameters the same as or better than those required by the Contracting Authority in the tender documentation. The Contracting Authority permits the offering of equivalent materials or devices. Materials or devices from specific manufacturers define the minimum quality parameters and utility characteristics, as well as qualitative characteristics (including: dimensions, composition, material used, color, shade, intended use of materials and devices, aesthetics, etc.) with which the materials or devices offered by the Contractor must comply in order to meet the requirements set by the Contracting Authority. The use of example manufacturer names is intended solely to clarify the Contracting Authority’s level of expectations regarding a specific solution.
