1. The subject of the contract is the implementation of the sentence entitled: Supply of SPECT/CT medical devices with equipment to the Department of Nuclear Medicine for the Central Clinical Hospital of the Medical University of Łódź at 251 Pomorska Street. The task is carried out as part of: The purchase of medical apparatus/equipment used to provide healthcare services financed from public funds under agreement with the State Treasury – Minister of Health No. DOI/SK/85112/6220/305/2026/681 for the granting in 2026 of a targeted subsidy for investment purchases in the Department of Nuclear Medicine for the Central Clinical Hospital of the Medical University of Łódź at 251 Pomorska Street. 2. A detailed description of the subject of the contract and implementation details are contained in the Description of the Subject of the Contract – List of Technical Parameters – Annex No. 2 (hereinafter referred to as the “OPZ), which consists of the following part: Technical parameters / detailed description of the subject of the contract – SPECT/CT device – 2 units. 3. The place of performance of the Contract is: Independent Public Healthcare Institution, Central Clinical Hospital of the Medical University of Łódź, with its registered office in Łódź at 251 Pomorska Street, 92-213 Łódź, Radiotherapy building. 4. Designation according to the Common Procurement Vocabulary CPV: 33100000 - 1 Medical devices 33190000 - 8 Miscellaneous medical devices and products 33111600 - 0 Radiography devices 33111620 - 3 Gamma-ray devices 45300000 - 0 Building installation work 45400000 - 1 Building completion work. 4. The scope of the subject of the contract includes delivery to the Contracting Authority’s registered office of a new, non-display device and the performance of construction works. The Contractor is obliged to familiarize itself with procedure P-310 Rules of Conduct for the Contractor and Subcontractor on the premises and in facilities belonging to CSK UM in Łódź. 5. The supplied equipment must meet the following conditions: a) it must be brand-new, non-display, and free from encumbrances by third-party rights, b) have a warranty period no shorter than that specified for the individual devices, equipment, and software in Annex No. 2 to the SWZ, c) on the tender submission date, the devices offered may not be designated by the manufacturer for withdrawal from production or sale, d) all devices supplied must come from a legal source and be covered by a warranty service package included in the price of the device. - full description in the SWZ. 6. NOTE: Whenever the documentation indicates the brand or origin of a product or device, it shall be assumed that the words “or equivalent” are placed after each name, meaning that the incorporated materials, devices, etc. will possess (be characterized by) all parameters no worse than those described in this documentation for the given item. 7. If specific technical solutions are indicated in the description of the subject of the contract, the use of equivalent solutions is permitted with regard to their features and parameters – specified for the given item of the subject of the contract, and all possible trade names of devices and products used in the description of the subject of the contract should be treated as standard definitions rather than specific trade names of devices and products used in this documentation. The burden of proving equivalence rests with the Contractor. 8. The Contracting Authority imposes the requirement referred to in Article 95(1) of the Act, namely the employment by the Contractor or subcontractor, under an employment contract, of persons performing activities during the performance of the contract within the scope of construction works – precise information is contained in the SWZ. 9. In the case of this procedure, the Contracting Authority refrained from dividing the contract into lots because it concluded that there is no possibility of dividing the contract into lots. Dividing the contract would result in excessive contract performance costs or require excessive simultaneous involvement of human resources to coordinate the activities of various contractors performing the individual parts of the contract, which could jeopardize its proper performance – detailed justification in the SWZ. 10. The scope of adaptation works is contained in the OPZ – Performance of adaptation of rooms enabling the SPECT/CT Laboratory to be commissioned. 11. The contract will be performed by 15.12.2026 for delivery of the devices and by 31.03.2027 for the adaptation works. 12. The scope and conditions of amendments are contained in the model contract constituting an annex to the SWZ. 13.
