Opportunity description

3.1. The subject matter of the contract is the successive delivery of reusable and disposable instruments and accessories for the "Da Vinci robotic system", divided into three packages. 3.2. A detailed description of the subject matter of the contract referred to in point 3.1. is provided in Annex No. 2 to the SWZ – Assortment and Price Form (OPZ), and Annex No. 8 to the SWZ – Draft Contract. 2.6. The Contracting Authority permits the submission of tenders for parts – 3 packages. 2.7. The Contracting Authority does not permit the submission of variant tenders. 2.8. The Contracting Authority does not permit the submission of equivalent tenders. 2.9. The Contracting Authority does not envisage concluding a framework agreement. 2.10. The Contracting Authority does not envisage contracts referred to in Article 214(1)(8) of the Act. 2.11. The Contracting Authority does not envisage conducting an electronic auction. 2.12. The Contracting Authority states that, prior to the opening of tenders, in accordance with Article 222(4) of the Pzp Act, it will disclose the amount it intends to allocate to the performance of the contract for the purpose of verifying whether the grounds for cancelling the procedure referred to in Article 255 point 3 of the Pzp Act have materialised. 2.13. Requirements concerning employment under an employment relationship in the circumstances referred to in Article 95 of the Pzp Act. - The Contracting Authority does not envisage any requirements in this regard. 2.14. Requirements concerning the employment of persons referred to in Article 96(2)(2) of the Pzp Act. - The Contracting Authority does not envisage any requirements in this regard. 2.15. Information on reserving the possibility of applying for the award of the contract exclusively to Contractors referred to in Article 94 of the Pzp Act. - The Contracting Authority does not envisage any reservations in this regard. 2.16. Requirements concerning options - The Contracting Authority does not envisage the possibility of exercising the option right in accordance with Article 441 of the Pzp Act. 2.17. The Contracting Authority does not envisage settlements in foreign currencies. 2.18. The Contracting Authority does not envisage establishing a dynamic purchasing system 2.19. The Contracting Authority does not envisage reimbursing the costs of participation in the procedure—unless the grounds under Article 261 of the PZP Act apply. 2.20. The Contracting Authority neither reserves the requirement nor permits the possibility of submitting tenders in the form of electronic catalogues or attaching electronic catalogues to the tender in the situation specified in Article 93 of the Pzp Act. 2.21. The Contractor is obliged to obtain all information that may be necessary to prepare the tender and sign the contract. 2.22. The procedure is conducted in Polish. 2.23. The Contracting Authority permits the participation of Subcontractors in the performance of the contract. 2.24. The Contracting Authority requires the contractor to indicate in the tender the parts of the contract that it intends to entrust to subcontractors and for the Contractor to provide the names of the subcontractors—in accordance with Article 462(2) of the PZP Act, if they are already known. 2.25. If a change or withdrawal of a subcontractor concerns an entity whose resources the contractor relied upon, under the rules specified in Article 118(1), in order to demonstrate fulfilment of the conditions for participation in the procedure, the contractor is obliged to demonstrate to the contracting authority that the proposed other subcontractor or the contractor itself fulfils them to a degree no less than the subcontractor whose resources the contractor relied upon during the contract award procedure. Article 122 of the Act shall apply accordingly. NOTE: in accordance with Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (i.e. Journal of Laws of 2024, item 507, as amended, hereinafter: the “Act”) - it is prohibited to entrust parts of the contract to subcontractors (including service and supply subcontractors) in respect of whom the grounds referred to in Article 5k(1)(a)-(c) apply, where they account for more than 10% of the contract value. 2.26. The Contracting Authority does not reserve the obligation for the contractor to personally perform key parts of the contract. 2.27. Entrusting part of the contract to subcontractors does not release the contractor from responsibility for the proper performance of the contract. 2.28. The Contracting Authority does not require a Contractor that intends to entrust the performance of part of the contract to subcontractors (but does not rely on the resources of those subcontractors) to demonstrate that no grounds exist for excluding them from participation in the procedure and to submit a European Single Procurement Document concerning the subcontractors (Article 462(5) of the PZP Act). 2.29. Contracting Authority Information concerning a site visit: The Contracting Authority does not envisage the possibility of the Contractor conducting a site visit; the contract does not require a site visit. Required contract performance period: from the date of conclusion of the contract until 29.07.2027. Justification for the contract performance period: The designation of the date 29.07.2027 results from the need to synchronise the new contract with the term of the existing contract. Because part of the assortment under the previous contract was exhausted ahead of schedule, the Contracting Authority's objective is to replenish the missing materials and align the contractual periods. This action guarantees the continuity of surgical procedures using the da Vinci system and prevents interruptions in the hospital's work. 3.1.
