Opportunity description

1) The subject of the contract is equipment for the endoscopy laboratory 2) The subject of the contract has been described in detail in Appendix No. 1 to the SWZ, Assortment and Price Form (Description of the Subject of the Contract - OPZ). 3) The detailed terms and conditions concerning the performance of the subject of the contract are regulated in the Model Contract, Appendix No. 4 to the SWZ (Contractual Terms) 4) The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract which it intends to entrust to subcontractors and to provide the names of the subcontractors – in accordance with Art. 462 sec. 2 of the PZP Act, if they are already known. 5) If a change or withdrawal of a subcontractor concerns an entity whose resources the Contractor relied upon, under the rules specified in Art. 118 sec. 1 of the PZP Act, in order to demonstrate compliance with the conditions for participation in the procedure, the contractor is obliged to demonstrate to the Contracting Authority that the proposed other subcontractor or the contractor independently meets them to a degree no less than the subcontractor whose resources the Contractor relied upon during the contract award procedure. The provision of Art. 122 of the PZP Act shall apply accordingly. 6) Requirements concerning contract performance: The Contracting Authority requires that the offered performance, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, environmental elements, service provision or accompanying solutions, shall not include: -ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 33 sec. 4 of the Act of 5 July 2018 on the National Cybersecurity System, stating their negative impact on the fundamental security interest of the state; -an ICT product whose type has been specified in the decision on recognising a supplier as a high-risk supplier, referred to in Art. 67b sec. 15 of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. 2.11. Accessibility requirements – Art. 100 Pzp The Contracting Authority requires that the offered devices, as equipment intended for use by patients, meet accessibility requirements for persons with disabilities, insofar as the nature of the device allows. In particular, the devices should feature an ergonomic design, low weight, clear signalling and the possibility of use by persons with reduced mobility. 2.13. The procedure has been prepared in accordance with the principles set out in the Charter of Fundamental Rights of the European Union and the provisions of the Public Procurement Law Act. The Contracting Authority has ensured compliance with the principles of equal treatment of contractors, transparency and proportionality. 2.14. Requirements concerning implementation of the DNSH principle. Performance of the subject of the contract must comply with the DNSH principle (Do No Significant Harm – “not causing significant harm to the environment”), in accordance with Art. 17 of Regulation (EU) 2020/852 of the European Parliament and of the Council and the guidelines for projects financed from the KPO. The Contractor undertakes to ensure that the offered supplies and services do not violate this principle and, if necessary, will submit appropriate statements or documents confirming compliance. The requirement to submit a statement also applies to subcontractors. Performance of the subject of the contract must ensure energy efficiency and reduced CO₂ emissions and enable recycling and reuse of elements after the end of their service life.
