The subject matter is the purchase and delivery of medical equipment, medical devices and furniture necessary to equip the AOS of the General Hospital in Kolno, in the quantities and assortment specified in Appendix No. 2 to the SWZ. Number of lots: 8. A detailed description of the subject matter of the contract is set out in Appendix No. 2 to the SWZ, constituting the detailed description of the subject matter of the contract and the technical requirements together with the assortment and price form. Information concerning the rules for performance of the subject matter of the contract, the warranty and remuneration is contained in Appendix No. 13 to the SWZ – draft contract (applies to lots No. 1-7) and Appendix No. 14 to the SWZ – draft contract (applies to lot No. 8). The public procurement procedure is conducted as an open tender pursuant to Art. 132 of the Act of 11 September 2019, Public Procurement Law (Journal of Laws of 2026, item 793), hereinafter referred to as the “PZP Act”. The procedure is conducted in accordance with the procedure applicable to supply contracts whose estimated value exceeds the amounts specified in Art. 4(c) of Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (Official Journal of the EU L 94 of 28.03.2014, p. 65, as amended), amended by Commission Regulation (EU) 2025/2152 of 22 October 2025 (Official Journal of the EU L 2025/2152 of 23.10.2025), i.e. above EUR 216,000, which is equivalent to PLN 930,960.00. Contractors may apply for the award of the contract if there are no grounds for their exclusion from the procedure pursuant to Art. 108(1) and Art. 109(1)(4) of the PZP Act, Art. 7(1) of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and protecting national security (Journal of Laws of 2025, item 514), and Art. 5k(1) of Regulation 2025/2033 of 23 October 2025 amending Regulation (EU) No. 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No. L 2025.2033), and if they meet the conditions specified below, i.e.: 1) they possess the appropriate technical or professional capacity: During the last three years prior to the deadline for submission of tenders (and, if the period of business activity is shorter, during that period), they have duly completed at least one delivery of an ultrasound machine, with a minimum gross value of: - for lot No. 1 – PLN 220,000.00 - for lot No. 3 – PLN 230,000.00 - for lot No. 6 – PLN 350,000.00 With regard to the remaining lots, i.e. lots No. 2, 4, 5, 7 and 8, the Contracting Authority does not impose any conditions for participation in the procedure. 13) The subject matter of the contract will be financed under the European Funds for Podlaskie Programme 2021-2027, project No. FEPD.04.05-IZ.00-0003/24 “Improving the quality of and access to AOS services at the General Hospital in Kolno”. 22) Pursuant to Art. 257 of the PZP Act, the Contracting Authority reserves the right to cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. Contract performance period: no more than 6 weeks from the date of conclusion of the contract – applies to all lots. GDPR information obligation – in accordance with the provisions of point 16 of the SWZ – “Information Clause – Art. 13 GDPR”. The Contracting Authority does not require a tender deposit. The Contracting Authority requires a performance bond (applies to all lots). Information concerning the bond is provided in point 13 of the SWZ. The Contracting Authority requires the Contractor to apply the DNSH principle (“do no significant harm”) when performing the contract. The performance of the contract is intended to limit adverse environmental impacts and promote environmental objectives, including the circular economy and waste reduction. The Contracting Authority requires that the subject matter of the contract, and in particular its manufacture and use during its life cycle, comply with the “do no significant harm” (DNSH) principle referred to in Art. 17 of Regulation (EU) 2020/852 of the European Parliament and of the Council of 18 June 2020. Information concerning the DNSH rules is described in point 3 of the SWZ and Appendix No. 11 to the SWZ. Information for a Contractor whose registered office or place of residence is outside the Republic of Poland is described in point 6.5 of the SWZ. The Contracting Authority permits the submission of tenders for individual lots. Each lot constitutes an indivisible whole and is not subject to further division. In accordance with Art. 107(2), the Contracting Authority will request the Contractor to submit or supplement the aforementioned subject-matter evidence within a specified time limit if the Contractor has not submitted the subject-matter evidence or the submitted subject-matter evidence is incomplete.
