The subject of the contract is the Supply of assembled Medical Rescuer Backpacks (with equipment) and components for the rotation of Tactical Rescue Kits for Units supplied by 32WOG in two lots: Lot No. 1 - supply of assembled Medical Rescuer Backpacks (with equipment); Lot No. 2 – supply of components for the rotation of Tactical Rescue Kits. Case No. ZP/PN/27/2026 For Lots No. 1, 2: CPV CODE: 33141620-2 - Medical kits – main 33140000-3 - Medical consumables DETAILED DESCRIPTION OF THE SUBJECT OF THE CONTRACT The subject of the contract is the supply of assembled Medical Rescuer Backpacks (with equipment) and components for the rotation of Tactical Rescue Kits for Units supplied by 32 WOG: LOT I supply of assembled PRS backpacks with equipment. A detailed description of the subject of the contract regarding the required technical parameters and quantitative demand is presented in the Price Form constituting Annex No. 1 to the tender for Lot No. 1 - constituting Annex No. 3 to the SWZ, respectively for Lot No. 1; LOT II supply of components for the rotation of Tactical Rescue Kits - a detailed description of the subject of the contract regarding the required technical parameters and quantitative demand is presented in the Price Form constituting Annex No. 1 to the tender for Lot No. 2 - constituting Annex No. 3 to the SWZ, respectively for Lot No. 2. 1. The goods supplied shall be: 1) brand-new; 2) packed in original packaging marked with the name of the manufacturer/importer and a description of the contents; 3) individually packed in internal, hermetically sealed packaging preventing contact with the atmosphere, moisture, etc. During transport and storage – this applies in particular to materials which may lose their properties when exposed to air; 4) supplied in packaging protecting against quantitative and qualitative changes; 5) where part of the subject of the contract requires repackaging, the subject of the contract must be supplied in protective packaging. 2. The goods supplied should meet the conditions for being placed on the market and put into use in the territory of the Republic of Poland specified by the Act of 7 April 2022 on medical devices, i.e. CE Certificates, declaration of conformity, notification concerning placement on the market at the Contracting Authority's request. 3. The goods supplied should be marked in accordance with Decision No. 3/MON of the Minister of National Defence of 3 January 2014 on guidelines specifying requirements for barcode marking of products supplied to the national defence sector (Official Journal of the Ministry of National Defence of 07.01.2014, item 11, as amended). 4. The shelf life of the offered goods may not be shorter than the period specified in the Operational and Technical Requirements (WET). 5. The goods supplied, manufactured in accordance with the content of the OPZ, must come from production no earlier than 2025, provided that the remaining shelf life on the date of delivery may not be less than 80% of the total shelf life. The detailed description of the subject of the contract for Lot No. 1 and Lot No. 2 is specified by: 1) Detailed description of the subject of the contract for Lot No. 1 – constituting Annex No. 1a to the SWZ; 2) Detailed description of the subject of the contract for Lot No. 2 – constituting Annex No. 1b to the SWZ. DETAILED REQUIREMENTS of the Contracting Authority regarding the supply 1. Provisions concerning the Contracting Authority's requirements regarding the supply are included in the draft contract constituting Annex No. 2 to the SWZ – respectively for the given lot. 2. The Contracting Authority does not require the Contractor or Subcontractor to employ, under an employment contract, any persons performing the Subject of the contract within the meaning of Article 22 § 1 of the Act of 26 June 1974, the Labour Code (consolidated text, Journal of Laws of 2025, item 277, as amended). 3. The Contracting Authority does not specify additional requirements related to the employment of persons referred to in Article 96(2)(2) of the Pzp. DETAILED REQUIREMENTS of the Contracting Authority concerning the option right 1. Optional orders – shall be placed depending on needs until the maximum amount specified in § 4(2) of the draft contract constituting Annex No. 2 to the SWZ is exhausted, but no later than 30.10.2026, with the proviso that the delivery period is 30 calendar days from the date of the order. 2. Under the contract, the Contracting Authority provides for a basic order and reserves the possibility of exercising the “option right” (option right – 100% of the basic order) within a scope not exceeding the range and quantities contained in Annex No. 3 to the SWZ (tender together with the price form - respectively for the given lot) - table “OPTIONAL ORDER”, which the Contractor accepts by concluding the contract. 3. The option may be activated after completion of the delivery of the basic order. 4. Goods purchased under the option right must meet all requirements applicable to the basic order. 5. The Contracting Authority stipulates that the part of the contract defined as the “option” is a right, not an obligation, of the Contracting Authority. The final quantity of goods supplied under the option will depend on the Contracting Authority's needs and the financial resources available for this purpose. The Contracting Authority may refrain from exercising the option, and the Contractor shall not be entitled to any claims against the Contracting Authority on this account. 6. The Contracting Authority may exercise the option right multiple times, until the maximum value specified in § 4(2) of the draft contract constituting Annex No. 2 to the SWZ is exhausted. The Contracting Authority may exercise the option right until 30.10.2026. 7. The Contracting Authority shall notify the Contractor in writing by e-mail of its intention to exercise the option right, its scope, and the places and dates for delivery of the optional supplies. Exercising the option right does not require an amendment to this Contract. 8. The remaining provisions concerning the Contracting Authority's requirements regarding the supply are included in the draft contract constituting Annex No. 2 to the SWZ – respectively for the given lot.
