Provision of occupational medicine services in the Małopolskie Voivodeship for employees of PP S.A. - 5 parts 1. The subject of the contract is the provision to the Contracting Authority of occupational medicine services in the Małopolskie Voivodeship for employees of PP S.A. - 5 parts, in particular preventive, pre-employment, periodic and follow-up examinations for employees of Poczta Polska S.A. and job candidates by facilities located in Kraków. 2. The subject of the contract has been divided into 5 parts: part 1 - Kraków. 3. Place of service provision: part 1 - in Kraków. 4. The anticipated number of employees referred for examinations during the term of the contract, as applicable to the respective part, is for part 1: Kraków – 6 302 persons. Detailed characteristics of the positions and the numbers of employees scheduled for examinations are included in the Pricing Form constituting Appendix No. 2.1 to the SWZ. The list of positions at Poczta Polska S.A. constitutes, as applicable to the part, Appendix No. 2 to the contract, and their characteristics, including a description of the activities performed in a given position, are contained in Appendix No. 1 to the contract. 5. The Contractor undertakes to provide the service from Monday to Friday, for at least 6 hours per day. This requirement also applies to subcontractors’ facilities. 6. The Contractor is required to specify in the tender form (Appendix No. 1 to the SWZ) the name and address of the facility where the medical services will be provided, within the administrative boundaries of the city: for part 1 - Kraków. 7. The Contracting Authority permits the submission of tenders for parts. The Contractor may submit a tender for one, several or all parts of the contract. Each partial contract will be evaluated separately according to the criterion specified in the SWZ. 9. The Contracting Authority does not permit the submission of variant tenders. 10. The Contracting Authority does not envisage conducting an electronic auction. 11. The Contracting Authority does not envisage convening a meeting of Contractors. 12. The Contractor shall price the cost of examining an employee on the basis of the characteristics of the individual job positions contained in the Pricing Form, constituting, as applicable to the part, Appendix 2.1 to the SWZ). The Contracting Authority does not specify the type and scope of examinations required because the sole decision-maker regarding the scope of examinations necessary for a given job position is an appropriately authorised occupational health physician, who assumes full responsibility for the examinations performed. 13. The Contracting Authority permits (in accordance with Art. 14 of the Occupational Medicine Service Act) the possibility of performing certain diagnostic examinations and specialist consultations at a Subcontractor’s facility, provided that all diagnostic examinations and specialist consultations necessary for the Contractor to issue a medical certificate/opinion to the Employee will be performed within the administrative boundaries of the above-mentioned city. 14. Pursuant to Art. 95(1) of the PZP, the Contracting Authority does not require the Contractor, subcontractor or further subcontractor to employ, under an employment relationship within the meaning of the Act of 26.06.1974 - Labour Code, persons performing activities related to contract performance 15. The Contractor may entrust the performance of part of the contract to a subcontractor, but may not entrust the performance of the entire contract to a subcontractor. 16. In its submitted tender, the Contractor is required to specify the parts of the contract that it intends to entrust to subcontractors. Failure to identify any subcontractor in the tender will indicate that the Contractor will perform the contract independently. A Contractor intending to entrust part of the contract to subcontractors assumes full responsibility for their proper and timely performance of that part of the contract (as for its own performance). 1.
