Opportunity description
1. The subject matter of the contract is the supply of an AFM atomic force microscope – 1 unit. 2. CPV code: 38510000-3 Microscopes 3. The delivered subject matter of the contract must be brand new, complete and technically operational. The term “brand new” shall mean the subject matter of the contract that has not been used before the date of delivery, excluding use necessary to test its proper operation after manufacture. The subject matter of the contract must be free from physical and legal defects and third-party claims. 4. A detailed description of the subject matter of the contract is provided in Annex No. 3 to the SWZ – OPZ. 5. The detailed scope of performance of the subject matter of the contract, constituting the draft provisions of the public procurement contract, is provided in the contract template constituting Annex No. 2 to the SWZ. 6. The required deadline for performance of the subject matter of the contract is: up to 22 weeks from the date of conclusion of the contract. 7. Pursuant to Art. 257 of the uPzp, the Contracting Authority provides for the possibility of cancelling this procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. 8. The Contracting Authority provides for the application of the so-called reverse procedure referred to in Art. 139(1) of the uPzp, i.e. the Contracting Authority will first examine and evaluate the tenders and then conduct the entity qualification of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 9. The Contractor is bound by the tender from the deadline for submission of tenders until 16/12/2026 (90 days). 10. The tender must consist of: 10.1. the Contractor’s tender form – an interactive form available on the e-Procurement Platform; 10.2. the declaration referred to in Chapter VII point 1 of the SWZ - JEDZ - an interactive form available on the e-Procurement Platform; 10.3. the declaration referred to in Chapter VII point 1a of the SWZ - (as applicable) Declarations in Annexes Nos. 5.1 and 5.2 to the SWZ; 10.4. (if applicable) the commitment of the entity making resources available, referred to in Chapter VII point 6 of the SWZ; 10.5. (if applicable) demonstration that information constituting a trade secret has been reserved in accordance with Chapter X point 6; 10.6. the document(s) establishing the right to sign the Tender in accordance with Chapter X point 18 of the SWZ; (if applicable) the relevant powers of attorney in accordance with Chapter X point 19 of the SWZ; 10.7. (if applicable) Declaration of Contractors jointly applying for the contract - in accordance with Art. 117(4) of the uPzp. 10.8. SUBJECT-MATTER EVIDENCE confirming that the supplies offered by the Contractor meet the requirements specified by the Contracting Authority and the characteristics of the description of the offered subject matter of the contract - the technical specification of the offered subject matter of the contract together with any Information for Contractors – enabling confirmation of the compliance of the offered device/set with the Contracting Authority’s requirements presented, as applicable, in Annex No. 3 to the SWZ – completed Annex No. 3 to the SWZ. The Contracting Authority considers the parameters indicated by the Contractor in Annex 3 to the SWZ OPZ, column Offered parameters, to constitute subject-matter evidence – confirmation that the requirements are fulfilled through the parameters offered by the Contractor. The requirement to indicate “Name, type, model, manufacturer” does not constitute subject-matter evidence. Pursuant to Art. 107 of the uPzp, if the Contractor has not submitted subject-matter evidence or the submitted subject-matter evidence is incomplete, the Contracting Authority will request its submission or supplementation within a specified deadline. This rule shall not apply if the subject-matter evidence serves to confirm compliance with the characteristics or criteria specified in the description of the tender evaluation criteria, i.e. the Contractor’s indication of information evaluated under the tender evaluation criteria is not subject to supplementation/submission pursuant to Art. 107(3) of the uPzp, or if, despite the submission of subject-matter evidence, the tender is subject to rejection or grounds exist for cancellation of the procedure. 11. Contractors who are not subject to exclusion under the rules specified in Chapter VI of the SWZ and who meet the conditions for participation in the procedure specified by the Contracting Authority may apply for the award of the contract. 11. Contractors who meet the conditions concerning the following may apply for the award of the contract: 2.1. capacity to conduct business activities The Contracting Authority does not impose a condition in the above scope. 1.
