Opportunity description

1. The subject matter of the contract is the supply of 6 bus-type vehicles in an unmarked police version. 2. A detailed description of the subject matter of the contract is provided in Appendix No. 5 to the SWZ and Chapter XIX of the SWZ. 3. The Contractor is obliged to specify in the Tender Form (template – Appendix No. 1 to the SWZ) the make, type, variant and trade designation of the offered vehicle, in accordance with the data contained in the EC certificate template. If the Contractor does not provide the above data, the Contracting Authority will reject the tender pursuant to Article 226(1)(5) of the Act as non-compliant with the contract conditions. 4. Each vehicle must be covered by a warranty for a period of: 1) min. 36 months with a limit of min. 100,000 kilometres of mileage – warranty for the mechanical, electrical and electronic components of the vehicle on which the body conversion was performed, 2) min. 36 months – warranty for the paint coating, 3) min. 72 months – warranty against perforation of bodywork components, 4) min. 36 months – warranty for the entire body conversion and vehicle equipment, 5) min. 36 months – warranty for the vehicle priority installation and devices, 6) min. 36 months – warranty for the communications installation – calculated from the date of acceptance of the vehicle by the Contracting Authority. 5. The Contracting Authority does not permit the submission of partial or variant tenders. 6. The Contracting Authority permits entrusting the performance of part of the contract to a Subcontractor. 7. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract whose performance it will entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 8. Tender validity period until 16.12.2026. 9. The Contracting Authority will make amendments to the contract in accordance with Chapter XIX of the SWZ. 10. Pursuant to Article 257 of the Pzp Act, the Contracting Authority provides for the cancellation of the procedure if the public funds that it intended to allocate to finance all or part of the contract have not been awarded to it. 11. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as “RODO”, the Contracting Authority informs that: 1) the controller of your personal data is the Commander of the Warsaw Metropolitan Police; 2) supervision over the proper processing of personal data is exercised by the data protection officer: address: ul. Nowolipie 2, 00-150 Warszawa; email address: iod@ksp.policja.gov.pl 3) your personal data will be processed pursuant to Article 6(1)(c) of RODO for the purpose related to the procedure conducted under the open tender procedure for the Supply of 6 bus-type vehicles in an unmarked police version (Procedure number: WZP-2609/26/147/T). 4) the recipients of your personal data will be persons or entities to whom the procedure documentation will be made available pursuant to Article 18 and Article 74(1) of the Act; 5) your personal data will be stored in accordance with Article 78 of the Act for a period of 4 years from the date of completion of the contract award procedure, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide personal data directly concerning you is a statutory requirement specified in the provisions of the Act, related to participation in the public procurement procedure; the consequences of failing to provide specific data arise from the Act; 7) with regard to your personal data, decisions will not be made by automated means, pursuant to Article 22 of RODO; 8) you have: a) pursuant to Article 15 of RODO, the right of access to personal data concerning you; b) pursuant to Article 16 of RODO, the right to rectify your personal data*; c) pursuant to Article 18 of RODO, the right to request that the controller restrict the processing of personal data, subject to the cases referred to in Article 18(2) of RODO**; d) the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of personal data concerning you infringes the provisions of RODO; 9) you are not entitled to: a) in connection with Article 17(3)(b), (d) or (e) of RODO, the right to erasure of personal data; b) the right to data portability referred to in Article 20 of RODO; c) pursuant to Article 21 of RODO, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is Article 6(1)(b), (c) and (f) of RODO. *Explanation: exercising the right to rectification may not result in a change to the outcome of the public procurement procedure or a change to the contractual provisions to an extent inconsistent with the Act, and may not compromise the integrity of the protocol and its appendices. **Explanation: the right to restriction of processing does not apply with regard to storage, for the purpose of ensuring the exercise of legal remedies or for the purpose of protecting the rights of another natural or legal person, or for important reasons of public interest of the European Union or a Member State. 12. The Contracting Authority does not require the Contractor to demonstrate compliance with the conditions specified in Article 112(2) of the Act. 13. Contractors that are not subject to exclusion pursuant to Article 108(1) and (2) of the Act and Article 109(1)(1), (4), (7), (8) and (10) of the Act, as well as Article 7(1) of the Act of 13.04.2022 on special arrangements for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2025, item 514), and Article 5k of Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L111 of 8.4.2022, p. 1), may apply for the award of this contract. 1. The subject matter of the contract is the supply of 6 bus-type vehicles in an unmarked police version, hereinafter referred to as the vehicle or vehicles. 2. A detailed description of the subject matter of the contract is provided in Appendix No. 5 to the SWZ and Chapter XIX of the SWZ. 3. The Contracting Authority requires the submission, together with the tender, of subject-matter evidence confirming the compliance of the offered vehicles with the requirements specified in the description of the subject matter of the contract, i.e. a template EC certificate of conformity for the base vehicle confirming the parameters contained in Appendix No. 5 to the SWZ in points: points 1.4.1.4-1.4.1.6, 1.4.2.1-1.4.2.3 and 1.4.5.1-1.4.5.3. 4. The Contracting Authority accepts equivalent subject-matter evidence if it confirms that the offered vehicles meet the requirements specified by the Contracting Authority. Subject-matter evidence produced by the Contractor (e.g. the Contractor’s own declaration) will not be deemed equivalent. 5. The Contracting Authority will award points under the tender evaluation criteria (maximum net engine power coefficient, actual mass of the base vehicle, fuel consumption in the WLTP combined cycle) based on data from the template EC certificate of conformity for the base vehicle. Despite permitting supplementation of the template EC certificate of conformity for the base vehicle, the Contracting Authority will not award points under these criteria if the document in question is not submitted together with the tender. 6. If the Contractor does not submit the subject-matter evidence or the subject-matter evidence is incomplete, the Contracting Authority will request its submission or supplementation within a specified deadline, subject to paragraph 7. 7. The Contracting Authority informs that, despite providing for such a request, it will not request the submission or supplementation of subject-matter evidence if, notwithstanding the submission of the subject-matter evidence, the tender is subject to rejection or grounds for cancellation of the procedure exist. 8. The Contracting Authority may request explanations from Contractors concerning the content of the subject-matter evidence. 9. Subject-matter evidence drawn up in a foreign language must be submitted together with a translation into Polish. Procedure: open. Estimated value: 8,822,764.22 PLN.
