Opportunity description

1. The subject of the contract is the supply of various medical devices, including implants used in the treatment of hearing loss, arthroscopic implants, and products used in neurosurgical procedures for Copernicus PL Sp. z o.o. The subject of the contract has been divided into 22 parts. 2. A detailed description of the subject of the contract, specifying the Contracting Authority’s requirements and estimated quantities, is contained in Annex No. 1 to the SWZ – Assortment and Price Form. By completing the items indicated in Annex No. 1 to the SWZ, the Contractor confirms compliance with the requirements specified by the Contracting Authority. 3. The manner of performing the subject of the contract is specified in the draft contracts – Annexes No. 5 to the SWZ, namely: a) Annex No. 5a to the SWZ – Draft contract – sale – concerning parts No. 4, 5, 12, 16, 17, 21, 22, b) Annex No. 5b to the SWZ – Draft contract – sale with loan for use – concerning parts No. 2, 3, 6, 7, 8, 18, c) Annex No. 5c to the SWZ – Draft contract – consignment without loan for use – concerning parts No. 10, 11, d) Annex No. 5d to the SWZ – Draft contract – consignment with loan for use – concerning parts No. 13, 14, 15, 19, 20, e) Annex No. 5e to the SWZ – Draft contract – sale – concerning part No. 1, f) Annex No. 5f to the SWZ – Draft contract – sale with loan for use – concerning part No. 9. 4. The maximum delivery period for a partial order is up to 5 working days (taking into account the further provisions of the SWZ – the delivery period constitutes a tender evaluation criterion). 5. Upon the first delivery, the Contractor is obliged to provide a list of medical equipment/instrumentation loaned for the duration of the contract, or is obliged with each delivery to provide a list of medical equipment/instrumentation loaned for the procedure in accordance with Annex No. 1A to the SWZ – if applicable. 6. The offered subjects of the contract must be complete, of a high standard in terms of both quality and functionality, and free from defects in materials, design, and legal title. 7. The offered subjects of the contract must be authorized for marketing and use in accordance with the applicable provisions of law. 8. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (consolidated text: Journal of Laws 2022.974 of 2022.05.09.), if the Contracting Authority requires the offering of an assortment constituting a medical device. 9. In all provisions of the SWZ and its annexes in which the Contracting Authority refers to standards, approvals, technical specifications, or reference systems, or where trademarks, parameters, or sources of origin (names of manufacturers or devices) are indicated, pursuant to Art. 99(5) and Art. 101(4) of the Pzp Act, the Contracting Authority permits equivalent solutions. 10. The term “equivalence” of a solution shall be understood in particular as: an indication that the offered solution has at least the same or better technical parameters and functional quality characteristics—described by the given standard, type, or mark—which relate to the utility values of the subject of the contract appropriate for the material, component, or product used, such as: functionality, performance, durability, service life, resistance, ease of use, safety, comfort of use, standard of finish, and characteristics describing the physical properties of the subject of the contract, such as size (length, width, height), volume, density, shape, color scheme, structure, and type of material and component. A Contractor relying on equivalent solutions is obliged to demonstrate that the supplies, services, or construction works it offers meet the requirements specified by the Contracting Authority. 11. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Art. 94 of the Pzp Act. 12. The Contracting Authority does not impose the requirements referred to in Art. 96 of the Pzp Act. 1.
