1. The subject matter of the contract is the supply of medical equipment and medical devices for the needs of Copernicus Podmiot Leczniczy Sp. z o.o. in Gdańsk. 2. The subject matter of the contract consists of 31 lots. 3. A detailed description of the subject matter of the contract, specifying the Contracting Authority’s requirements and estimated quantities, is contained in Appendix No. 1 to the SWZ – Assortment and Price Form, which the Contractor shall attach to the tender. By completing the indicated items in Appendix No. 1 to the SWZ, the Contractor confirms compliance with the requirements specified by the Contracting Authority. 4. The scope and method of performance of the subject matter of the contract are specified by the draft contracts, namely: a. Appendix No. 3A to the SWZ – Draft contract (one-off delivery) – for lots 1-2, 8, 10-26, 28-30, b. Appendix No. 3B to the SWZ – Draft contract (contract for successive deliveries for 24 months) – for lots 3-7, 9, 27 and 31. 5. The maximum period for completing the one-off delivery is 9 weeks, while the period for completing delivery of a partial order is up to 5 working days, taking into account the further provisions of the SWZ. The delivery completion period constitutes one of the tender evaluation criteria. 6. The offered items covered by the contract must be authorized for marketing and use in accordance with the applicable provisions of law. 7. The offered items covered by the contract must be complete, of a high standard in terms of both quality and functionality, and free from material, design and legal defects. 8. The subject matter of the contract must comply with the Act of 7 April 2022 on medical devices (Dz.U. 2022 poz. 974, as amended) – where applicable. 9. In all provisions of the SWZ and its appendices in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems, or where trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, pursuant to Art. 99(5) and Art. 101(4) of the Pzp Act, the Contracting Authority permits equivalent solutions. 10. The term “equivalence” of a solution is understood in particular as indicating that the offered solution has at least the same or better technical parameters and functional quality characteristics—described by a given standard, type or mark—which relate to the utility values of the subject matter of the contract and are appropriate for the material, component or product used, such as: functionality, efficiency, durability, service life, resistance, ease of use, safety, user comfort, standard of finish, as well as characteristics describing the physical properties of the subject matter of the contract, such as size (length, width, height), volume, density, shape, color scheme, structure, and type of material and component. A Contractor relying on equivalent solutions is obliged to demonstrate that the supplies, services or construction works it offers meet the requirements specified by the Contracting Authority. 11. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Art. 94 of the Pzp Act. 12. The Contracting Authority does not impose the requirements referred to in Art. 96 of the Pzp Act. 13. In connection with the performance of the contract, the Contracting Authority does not provide for an obligation to perform the key tasks of the contract personally. 14. A condition for participation in the public procurement procedure is the provision of a tender guarantee in the appropriate amount. Details, including the tender guarantee amounts for tenders covering all lots and tenders covering individual lots, are described in § XVI of the SWZ. 15. Before selecting the most advantageous tender, the Contracting Authority shall call upon the Contractor whose tender received the highest score to submit, within a specified period of no less than 10 days, the entity-related evidence described in § X(1) of the SWZ, valid as at the date of submission. 16. The Contracting Authority states that it will first examine and evaluate the tenders and then conduct the entity qualification of the contractor whose tender received the highest score with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. 17. Subject-matter evidence: 1. In order to confirm that the offered assortment meets the requirements specified by the Contracting Authority, the Contracting Authority requires the submission together with the tender of the subject-matter evidence indicated separately for each lot in Appendix No. 1 to the SWZ – Assortment and Price Form (in the item entitled “Required documents”), provided that: - each page of the documents must be marked to indicate the scope and item to which it relates, - if equivalent solutions other than those specified in the SWZ are offered, documents confirming that the equivalent solutions used meet the Contracting Authority’s requirements (e.g. descriptions, catalog sheets, technical data sheets) must be attached to the tender. 2. The Contracting Authority states that if the subject-matter evidence referred to above is not submitted together with the tender, or if the submitted subject-matter evidence is incomplete, the Contracting Authority shall call for its submission or supplementation within a specified period. 3. If the subject-matter evidence serves to confirm compliance with the characteristics or criteria specified in the description of the tender evaluation criteria or if, despite the submission of the subject-matter evidence, the tender is subject to rejection or there are grounds for cancelling the procedure, the Contracting Authority shall not call for the submission or supplementation of the subject-matter evidence. 4. The Contracting Authority may request explanations from contractors concerning the content of the subject-matter evidence. 1.
