1. The subject matter of the contract is the sale and delivery of a set of obstetric manikins. The Contracting Authority does not permit the submission of partial tenders. Reasons for not dividing the contract into lots: The subject matter of the contract constitutes a functional whole; dividing the contract into lots could result in excessive technical difficulties and excessive contract performance costs; furthermore, the absence of division is justified by organizational considerations, as a possible division of the contract could seriously jeopardize proper contract performance, and the need to coordinate the activities of different contractors performing individual parts of the contract could jeopardize the correct and timely performance of the contract. Furthermore, not dividing the contract into lots does not infringe competition by limiting the possibility of competing for it. 2. A detailed description and the method of contract performance are contained in the Description of the Subject Matter of the Contract (OPZ), constituting Annex No. 1.1 to the SWZ. 3. The Contracting Authority envisages applying the so-called reverse procedure referred to in Art. 139(1) of the PZP Act. 4. Pursuant to Art. 257 of the PZP, the Contracting Authority envisages the possibility of cancelling these proceedings if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. 5. The Contracting Authority does not require the submission of a bid bond. 6. The Contracting Authority does not require the provision of a performance bond. 7. A detailed description and the method of contract performance are contained in the Description of the Subject Matter of the Contract (OPZ), constituting Annex No. 1.1 to the SWZ: a) The proposed assortment/devices must be new, unused and free from defects, and their technical and functional parameters must be no lower than those presented in the Description of the Subject Matter of the Contract constituting Annex No. 1.1 to the SWZ. b) The proposed software must be free from defects, and its technical and functional parameters must be no lower than those presented in the detailed Description of the Subject Matter of the Contract constituting Annex No. 1.1 to the SWZ. c) The Contracting Authority permits the submission of equivalent tenders. Wherever the Contracting Authority describes the subject matter of the contract by indicating trademarks or patents, or by reference to standards, European technical assessments, approvals, origin, technical specifications and/or technical reference systems, the Contracting Authority permits solutions equivalent to those described.
